An Act to amend and reenact § 14.1-86, as amended, of the Code of Vt
ginia, relating to fees accruing to certain officers in criminal pr
ceedings. ,

Be it enacted by the General Assembly of Virginia:
1. That § 14.1-86, as amended, of the Code of Virginia be amended an
reenacted as follows:
§ 141-86. No justice of the peace, judge, constable, sergeant, ¢
captain or sergeant of police who receives a salary or allowance for gener:
service out of the treasury of his county or corporation shall receive an
fees for services in a criminal case from the State, city or county, but a
such fees to such officers shall be paid by the party against whom judgmer
is rendered, provided, however, that whenever any such fees accruin
to any person mentioned in this section who does not receive such salar
serving criminal process of any kind, which allowances shall be paid out
of the treasury. When any incorporated community has become a city of
the second class under Chapter 22 (§ 15.1-978 et seq.) of Title 15.1, then the
allowance above provided for shall be made by the circuit court of such city.
