An Act to amend and reenact § 8-801 of the Code of Virginia, relating to
subpoena duces tecum; how issued; when obtainable. 'S 2581

Be it enacted by the General Assembly of Virginia:

That § 8-301 of the Code of Virginia be amended and reenacted as
ollows:

§ 8-801. When it appears by affidavit that any book, writing or
document in the possession of a person not a party to the matter in con-
troversy, is material, and proper to be produced before a court, or any
person appointed by it or acting under its process or authority in a judicial
or quasi judicial capacity, such court, or a judge thereof in vacation upon
notice to the party adverse to the party requesting the same, may order
the clerk of such court to issue a subpoena duces tecum to compel such
production at a time and place to be specified in the order.
