Be it enacted by the General Assembly of Virginia:
1. That §§ 18.1-38 and 18.1-39 of the Code of Virginia be amended anc
reenacted as follows:
§ 18.1-38. Abduction with the intent to extort money, or pecunian
benefit, abduction * of any * person with intent to defile * such person
and abduction of any female under sixteen years of age for the purpos
of concubinage or prostitution shall be punished with death, or by con
finement in the penitentiary for life or any term not less than three years
§ 18.1-39. Any person who (1) threatens, or attempts, to abduc
any other person with intent to extort money, or pecuniary benefit, 01
(2) assists or aids in the abduction of, or threatens to abduct, any ‘
person with the intent to defile * such person, or (3) assists or aid:
in the abduction of, or threatens to abduct, any female under sixtee!
vears of age for the purpose of concubinage or prostitution, shall b
punished by confinement in the penitentiary for not less than one nol
more than twenty years, or, in the discretion of the jury or the cour
trying the case without a jury, by a fine of not more than one thousanc
dollars or by confinement in jail for not more than twelve months, 01
both such fine and confinement.
