An Act to amend and reenact § 15.1-492 of the Code of Virginia, relating
to nonconforming uses. [8 869)

Be it enacted by the General Assembly of Virginia:
1. That § 15.1-492 of the Code of Virginia be amended and reenacted as
ollows:
§ 15.1-492. Nothing in this article shall be construed to authorize
the impairment of any vested right, except that a zoning ordinance may
provide that land, buildings, and structures and the uses thereof which
do not conform to the regulations and restrictions prescribed for the
district in which they are situated may be continued only so long as the
then existing or a more restricted use continues and such use is not dis-
continued for more than two years, and so long as the buildings or struc-
tures are maintained in their then structural condition; and that the uses
of such buildings or structures shall conform to such regulations when-
ever they are enlarged, extended, reconstructed or structurally altered;
and may further provide that no “nonconforming” building or structure
may be moved on the same lot or to any other lot which is not properly
zoned to permit such “nonconforming” use.

relating to jurisdiction of circuit courts to establish certain projects.

1. That § 21-292, as amended, of the Code of Virginia be amended anc
reenacted as follows:
§ 21-292. The circuit courts of the several counties and cities of this
State shall have jurisdiction, power and authority to establish a levee, 0}
drainage project or projects, in their several counties and cities and 1r
projects as hereinafter set out, and to locate and establish levees, drains 01
canals and cause to be constructed, straightened, widened or deepened an}
land drainage, ditch, drain or watercourse, and to build levees or embank-
ments and erect tide gates and pumping plants for the purpose of draining
and reclaiming wet, swamp or overflowed lands.
