CHAPTER 146
An Act to amend and reenact §§ 4.01, 16.06, 17.02, and 17.15, as amended,
of Chapter 828 of the Acts of Assembly of 1950, approved Apri 4,
1950, which provided a Charter for the city of Falls Church the sec-
tions relating to composition of the council, the advisory board of
recreation and parks, city planning commission and the board of zon-
ing appeals

Be it enacted by the General Assembly of Virginia:
1. That §§ 4.01, 16.06, 17.02 and 17.15, as amended, of Chap. 323
of the Acts of Assembly of 1950, approved April 4, 1950, be amended
and reenacted as follows:
§ 4.01. The council shall consist of seven members, who shall be
qualified voters of the city actually residing within the corporate limits,
and they shall be elected as provided in Chapter 3. They shall each receive
in full compensation for their services the sum of * one hundred dollars
per month and shall not be entitled to any other allowance of any kind
except that the mayor or vice-mayor when acting as mayor, or any
member of the council, subject to the approval of the council, may be
allowed his actual expenses incurred in representing the city. No member
of the council shall during the term for which he was elected and one
year thereafter be appointed to any office of profit under the government
of the city
§ 16.06. There shall be an advisory board of recreation and parks
consisting of five members, of whom one shall be a member of the school
board, appointed by the school board, and one a member of the city
planning commission, appointed by the city planning commission, for
terms of two years from the first Tuesday in September nineteen hundred
and fifty-one and every two years thereafter, but in no case shall a member
so appointed continue to be a member of the advisory board of recreation
and parks after the expiration of his term as a member of the school
board or the city planning commission, as the case may be; and of whom
three shall be appointed by the council for terms of three years, provided
that the members in office at the effective date of this charter are hereby
continued in office for the terms they were appointed, and new appoint-
ments shall be made annually from the first Tuesday in September in such
a manner that one or more, but less than three, of the appointments
expire annually. Vacancies shall be filled by the Authority making the
appointment, for the unexpired portion of the term. The advisory board of
recreation and parks shall choose annually one of its own number to be
chairman for a term of one year and until his successor is chosen and
qualified. An employee of the department of recreation and parks shall
be assigned by the director of recreation and parks to act as secretary of
the board. It shall hold such regular meetings as it may determine.
Special meetings may be held at any time on the call of the director of
recreation and parks or of the chairman of the advisory board of recrea-
tion and parks. The advisory board of recreation and parks shall advise
with the director of recreation and parks. *
§ 17.02. There shall be a city planning commission which shall
consist of seven members appointed by the Council. * One member shal!
be a member of the Board of Zoning Appeals appointed for a term
coincident with his term on such board; * six citizen members shall be
qualified voters of the city, actually residing within the city limits, who
hold no office of profit under the city government, appointed for terms
of four vears; provided, * that the five citizen members in office on June
thirty, ninetcen hundred sixty-six, shall continue for the length of their
appointed terms. A sixth citizen member shall be appointed to serve
from the first day of July, nineteen hundred sixty-six for a term ex-
pirtng on the thirty-first day of December, nineteen hundred sixty-eight.
Effective the first day of January, nineteen hundred sixty-seven, and every
four years thereafter, three citizen members shall be appointed, and
effective the first day of January, nineteen hundred sixty-nine, and every
four y ears thereafter, three citizen members shall be appointed. Vacan-
cies sknall be filled for the unexpired portion of the term. A member
may be removed by the council for neglect of duty or malfeasance in
office. wpon written charges and after public hearing. *
§ 17.15. There shall be a board of zoning appeals which shall con-
sist of five regular members and one alternate. They shall be qualified
voters of the city, shall reside within the city limits, shall hold no office of
profit under the city government and shall be appointed by the council
for terms of four years; provided that the members of the board of zoning
appeals in office at the effective date of this charter shall continue to hold
office until the first day in January following the expiration of the
terms for which they were appointed, and the first alternate member
shall be appointed to serve until the said date; and provided, further,
that the council shall appoint two regular and one alternate member to
serve for two vears, and three regular members to serve for four years
from said date. Thereafter, their successors shall be appointed for full
terms of four years. Vacancies shall be filled by the council for the un-
expired portion of the term. A regular or alternate member may be
removed by the council for neglect of duty or malfeasance in office, upon
written charges and after public hearing. *
