An Act to authorize the Virginia Institute of Marine Science to acquire
certain land by purchase or condemnation and to prescribe procedures
mn connection therewith.

Be it enacted by the General Assembly of Virginia:
1. § 1. The Virginia Institute of Marine Science may acquire by pur-
chase or by exercise of the power of eminent domain, the following
described real estate, deemed necessary for its purposes:
ll that piece or parcel of real estate, with improvements thereon,
lying and being in the County of Gloucester, State of Virginia, and more
particularly described as follows:
Those certain parcels of land located at Gloucester Point, Gloucester
County, Virginia, which are shown as a whole outlined in red on a photo
copy of Plat R/W File #516-C dated May 27, 1952, made by the Virginia
Department of Highways and recorded in the Clerk’s Office of the Circuit
Court of Gloucester, Virginia, with a deed dated February 25, 1953, in
Deed Book 96, page 187; those parcels referred to above being reduced
by the conveyance of Lot 6A, a portion of Lot 6, as recorded in the Clerk’s
Office of the Circuit Court of Gloucester, Virginia, in Deed +81, Deed
Book 117, page 306.
The above mentioned parcels are more fully described as follows:
Beginning at a point (southwest corner of 6A) 20 feet westwardly
along the south line of Lot 6A from the iron pin marking the southeast
corner of Lot 6A, said Lot 6A having been conveyed by George G. Burk-
hardt, George D. Thomas and Theresa A. Thomas, his wife, to the Vir-
ginia Fisheries Laboratory of the College of William and Mary and the
Commission of Fisheries by deed dated October 2, 1959, and recorded in
the Clerk’s Office of the Circuit Court of Gloucester County in Deed Book
117, page 306; said point and southwest corner of Lot 6A being in the
mean low water line of the York River; thence along the south line of
Lot #6 and Lot #7 and across the former ferry slip and approach, S 50°
40’ 15” W 196.19 feet to an iron pin, thence N 25° 57’ 45” W 67 feet, more
or less, to a point in a projection westerly of the northern edge or line of
the former approach concrete apron; thence easterly along said projection
and north edge of line 40 feet, more or less, to the northeast corner of said
concrete apron; thence northwesterly 36 feet, more or less, to an iron pin
in the northwest corner of Lot +7 and in the east and south line of the
30 foot right of way of the former ferry approach road; thence with said
right of way line, the arc of a 109.56 foot radius curve to the right, con-
centric with and 15 feet from the centerline of said right of way, (a) 122
feet, more or less, to the northwesterly corner of Lot #6 and, (b) 6 feet,
more or less, to the end (or beginning) of said curve, opposite said cen-
terline at survey station 3 + 25.15; thence along said right of way line
parallel to and 15 feet from said centerline, N 54° 32’ 30” E 22.04 feet to
a point opposite the beginning (or end) of a 174.16 foot radius curve to
the left opposite said centerline at survey station 3 +03.11; thence along
said right of way line and curve to the left, concentric with and 15 feet
from said centerline 90 feet, more or less, to an iron pipe in the north-
easterly corner of the land herein described and the northwesterly corner
of said Lot #6A conveyed to the Virginia Fisheries Laboratory; thence
with the line dividing Lot #6A and Lot #6 S 20° 39’ 30” E 180.17 feet
to the beginning; together with right of ingress and egress over and along
said 30 foot former approach road and with any and all improvements,
appertaining and belonging thereto which the owners may have beyond
the mean low water line of the York River adjacent to and along the land
here described.
Title to land so acquired shall be in the name of the Commonwealth.
In the exercise of the power of eminent domain granted under this act,
the Institute may proceed in the manner provided by law for the State
Highway Commissioner in §§ 33-57 through 33-75 as amended of the
Code of Virginia.
