Chap. 64.—An ACT to amend an act entitled “An act to provide for licensing
dealers in motor fuel; to require certain reports by such dealers and certain
other persons; to levy a tax upon motor fuel; to provide for its collection ;
to appropriate the revenue raised by the same; to prescribe penalties for
violations ; and to repeal an act of the General Assembly entitled, an act to
levy a tax upon motor vehicle fuel; to provide for its collection; to appro-
priate revenue raised by the same, and to prescribe penalties, approved March
26, 1923, and to repeal all acts amendatory thereof, and all other acts and
parts of acts in conflict with the provisions of this act,’ approved March 23,
1932, by adding thereto a new section numbered section 8-a, providing for
refunds of motor vehicle fuels in certain cases. [S. B. 38]

1. Be it enacted by the General Assembly of Virginia, That an act
entitled “An act to provide for licensing dealers in motor fuel; to re-
quire certain reports by such dealers and certain other persons; to levy
a tax upon motor fuel; to provide for its collection; to appropriate the
revenue raised by the same; to prescribe penalties for violations ; and to
repeal an act of the General Assembly entitled, an act to levy a tax upon
motor vehicle fuel; to provide for its collection; to appropriate revenue
raised by the same, and to prescribe penalties, approved March twenty-
sixth, nineteen hundred and twenty-three, and to repeal all acts
amendatory thereof, and all other acts and parts of acts in conflict with
the provisions of this act,” approved March twenty-third, nineteen
hundred and thirty-two, be amended by adding thereto a new section
numbered eight-a, which section shall read as follows:
Section 8-a. It is hereby provided that the State Highway Commis-
sioner shall establish two zones within the limit of fifteen miles distant
from the District of Columbia line and the State line of any State
where the tax on gasoline is less than three cents per gallon. Upon all
motor vehicle fuels sold in the first zone bordering on said State lines
and/or District of Columbia there shall be refunded to the retailer
selling the same the excess in amount per gallon of the tax imposed by
this State over the tax imposed by the adjoining State or District of
Columbia, except that the refund shall not exceed two cents per gallon.
Upon motor vehicle fuel sold within the second zone further distant
from said State lines or District of Columbia, there shall be so refunded
the excess in amount of the tax imposed by this State over the tax im-
posed by said adjoining State or District of Columbia, but the refund
shall not in such case exceed one cent per gallon.
Such refunds shall be made only to the retailer of such motor vehicle
fuels who has actually sold and delivered the same at his place of busi-
ness into the tank of the vehicle of the purchaser. Applications for
refunds shall be made within sixty days from the date of sale to the
Division of Motor Vehicles upon forms furnished by it.
The Director of the Division of Motor Vehicles is authorized and
empowered to make all necessary rules and regulations for carrying
out the provisions of this section.
The purpose of this section is to provide relief for persons selling in
Virginia motor vehicle fuels in sections of Virginia adjacent or near to
States, including the District of Columbia, where the tax imposed upon
motor vehicle fuels is materially lower than that imposed in this State,
such condition having resulted in a present emergency due to the fact
that persons selling motor vehicle fuels are now prohibited from ab-
sorbing any part of the tax imposed upon such motor vehicle fuels.
This section shall cease to be in effect at the expiration of six months
after the day on which this section shall become effective, or sooner
if the Governor shall by proclamation declare that the emergency re-
cognized by this paragraph has ended.
2. An emergency existing, this act shall be in force from its passage.
