Chap. 59.—An ACT to amend and re-enact section 30 of an act entitled an act
to appropriate the public revenue for the two years ending, respectively, on
the thirtieth day of June, 1933, and the thirtieth day of June, 1934, approved

1. Be it enacted by the General Assembly of Virginia, That section
thirty of an act entitled an act to appropriate the public revenue for
the two years ending, respectively, on the thirtieth day of June, nine-
teen hundred and thirty-three, and the thirtieth day of June, nineteen
hundred and thirty-four, approved March eighteenth, nineteen hundred
and thirty-two, be amended and re-enacted so as to read as follows:
Section. 30. Subject to the qualifications in this section contained,
all appropriations now or hereafter made payable out of the general
fund of the State treasury are hereby declared to be maximum, con-
ditional and proportionate appropriations, the purpose being to make
the appropriations payable in full in the amounts named herein if

necessary and then only in the event the aggregate revenues to be col-
lected and available during each fiscal year of the biennium for which
such appropriations are made, are estimated by the Governor to be
sufficient to pay all of the appropriations in full; otherwise, the said
appropriations shall be deemed to be payable in such proportion as the
total sum of all appropriations out of the general fund of the treasury
bears to the total amount of general fund revenue estimated by the
Governor as available in each of said fiscal years. The Governor is
hereby given full power and authority to examine and survey the prog-
ress of the collection of the revenue out of which such appropriations
may be payable, and to declare and determine the amounts that can,
during each quarter of each of the fiscal years of the biennium, be
properly allocated to each respective appropriation. In making such
examination and survey, he may require estimates of the prospective
collection of revenues from the Comptroller, the State Tax Commis-
sioner, the State Corporation Commission and any other revenue as-
sessing or collecting agency of the State having information which, in
the opinion of the Governor, may be pertinent. The Governor shall,
subject to the qualifications in this section contained, reduce all of said
appropriations pro rata when necessary to prevent an overdraft or
deficit for the fiscal period for which appropriations are made. Such
pro rata reductions shall be applied to all fees, charges and commissions,
including allowances to local officers, the amount of which is fixed by
or under general law, paid out of the general fund. The purpose and
policy of this act are to provide and insure, subject to the qualifica-
tions in this section contained, that there shall be no overdraft or
deficit in the general fund of the State treasury at the end of the fiscal
period, and the Governor is directed so to administer this act.
In exercising the powers and performing the duties set forth in
the preceding paragraph, the Governor shall in no case reduce any
appropriation therein referred to, to any amount less than seventy per
centum of the original appropriation.
This section shall not be construed as requiring any reduction to
be made in the amounts herein appropriated for the payment of interest
and sinking fund installments on the bonded debt of the State govern-
ment, nor as requiring a reduction in the salary of any State officer
where such reduction would be contrary to the Constitution of the
State.
Provided, however, that there shall be excepted from the reduction
heretofore made by the Governor in the appropriation to the Confed-
erate veterans and their widows for the fiscal year ending June thirtieth,
nineteen hundred and thirty-four, and there be restored to said ap-
propriation a sum sufficient to pay the pensions to said Confederate
veterans and their widows who married prior to October first, eighteen
hundred and eighty, and who have not married. in full, as provided by
law, from the period beginning October first, nineteen hundred and
thirty-three, and ending June thirtieth, nineteen hundred and thirty-
four, and the sum hereby restored, shall be used to pay to Confederate
veterans and their widows who married prior to October first, eighteen
hundred and eighty, and who have not remarried, the full pension pro-
vided by law during the period beginning October first, nineteen hun-
dred and thirty-three, and ending June thirtieth, nineteen hundred and
thirty-four.
Provided, however, that there shall be excepted from the reduction
heretofore made by the Governor in the appropriation to the State
Board of Education, for the fiscal year which began July first, nineteen
hundred and thirty-three, and restored to said appropriation a sum
sufficient, not to exceed one hundred and fifty thousand dollars, which
may be used by the State Board of Education by and with the authority
and approval of the Governor first obtained, to prevent the closing of
any public school or schools in Virginia until the General Assembly at
its next regular session shall enact further legislation for the purpose
of insuring, in co-operation with the respective localities, a minimum
public school term of eight months throughout the State.
In the preparation of the executive budget for the biennium which
begins July first, nineteen hundred and thirty-four, the Governor is
hereby directed to set aside out of the estimated receipts into the general
fund of the treasury for said biennium, a sufficient amount to discharge
any deficit which the Comptroller’s estimates may show will exist in
the said general fund at the close of business on June thirtieth, nine-
teen hundred and thirty-four.
Provided, further, that no further reductions shall be made in the
salary or compensation of any officer or employee of any division,
department or agency of the State which will reduce any such salary
or compensation below the reduction in effect August seventeenth,
nineteen hundred and thirty-three, and all such salary and compensa-
tion reductions heretofore ordered by the Governor in the executive
department are hereby confirmed and ratified.
2. An emergency existing, this act shall be in force from its passage.
