Chap. 5.—An ACT to authorize the State Commission on Conservation and De-
velopmeni, the town of Virginia Beach, and any agency of the Federal gov-
ernment to open, clear, deepen and widen channels from Chesapeake Bay
through Lynnhaven Inlet, Long Creek, Broad Bay and Linkhorn Bay, in the
county of Princess Anne; to confer the right of eminent domain for such
purpose; and to authorize the town of Virginia Beach to participate in, and
take advantage of the provisions of an act of the Congress of the United
States, approved June 16, 1933, and known as the National Industrial Re-
covery Act. [S. B. 17]

1. Be it enacted by the General Assembly of Virginia as follows:
Section 1. For the purpose of promoting the public health, con-
serving and developing the seafood resources of the State, and improv-
ing the public rights of navigation herein, authority is hereby conferred
upon the State Commission of Conservation and Development, the town
of Virginia Beach, and any agency of the Federal government, to open,
clear, deepen and widen channels from Chesapeake Bay through Lynn-
haven Inlet, Long Creek, Broad Bay and Linkhorn Bay, in the county
of Princess Anne.
Section 2. The authority above conferred may be exercised by the
State Commission on Conservation and Development, the town of Vir-
ginia Beach, and any agency of the Federal government or by any one
or more of them.
Section 3. The right of eminent domain, when necessary to be ex-
ercised in connection with the improvements herein authorized, is hereby
conferred upon the said Commission, town, and agency of the Federal
government, whether acting separately or any two or more acting to-
gether, such right to be exercised in accordance with the appropriate
statutes and acts, general and special, concerning the exercise of the
right of eminent domain, including the act or acts conferring such right
upon the State Commission on Conservation and Development.
Section 4. The said town of Virginia Beach, in addition to the au-
thority conferred upon it by its charter or by any general or special
statute, is hereby authorized and empowered to enter into any and all
contracts deemed necessary or desirable by said town, with the United
States of America, and any agency thereof, and/or any person, firm or
corporation, for the construction, repair or improvement of any project
to be included in the program of public works referred to in an act of
the Congress of the United States, approved June sixteenth, nineteen
hundred and thirty-three, and known as the National Industrial Re-
covery Act; and for such purpose the said town of Virginia Beach is
hereby authorized and empowered, (1) to acquire, by purchase or by the
exercise of the power of eminent domain, any real or personal property
in connection with the construction of any such project, and to sell, lease
or convey the same to the United States of America, or any agency
thereof, and to lease any such property from the United States of
America, and to contract for the repurchase of same; (2) to borrow
money from the United States of America, or any agency thereof, for
the purpose of effecting the construction of any such project, and to
issue its bonds and other securities for such purpose; and (3) to impose,
levy and collect any and all taxes, special levies and assessments, in-
cluding any reasonable tolls and charges for the use and enjoyment of
said project, deemed necessary or desirable for the payment of the cost
of said project, in whole or in part, and interest thereon.
Section 5. The credit of the State shall not be pledged, nor shall any
indebtedness against the State be incurred in connection with the im-
provements herein authorized to be made, unless otherwise authorized
by law. ,
2. An emergency existing, this act shall be in force from its passage.
