Chap. 56.—An ACT to amend and re-enact section 28, chapter 78 of
the Code of 1873, to provide for tuking the Census of School Popu-
lation.
Approved January 19, 1875.
1. Be it enacted by the general assembly of Virginia, That
section twenty-eight of chapter seventy-eight of the Code of
Virginia of eighteen hundred and seventy-three, be amended,
and re-enacted so as to read as follows:
§ 28. It shall be the duty of the clerk of the district school
board, during the month of June or July, eighteen hundred
and seventy-five, and every three years thereafter, to take a
census of all persons residing within the school district be-
tween the ages of five and twenty-one years, and to gather
statistics relating to the interests of education in the district,
according to forms furnished from the office of the superin-
tendent of public instruction. The lists thus prepared shall
be submitted for careful revision -to the district school board,
as soon as may be after their completion, and shali at all
times be open to the inspection of any citizen. They shall
ulso be submitted along with the other papers of the district
to the county board, at its annual meeting, and shall be im-
mediately thereafter delivered to the county or city superin-
tendent of schools. For this service the clerk shall receive
out of the district school funds, a compensation therefor at
the rate of three dollars per hundred for the children listed
by him, subject to abatement or fine by the district board,
on the discovery before or after the settlement of the account
of errors or omissions in tho list, as provided in section forty
of this act. All errors in the lists shall be rectified by the
clerk, without extra compensation. It shall be the duty of
the county superintendent to exercise special care in securing
& prompt and accurate discharge of this duty by the district
clerks. The duty of taking the census of the school popula-
tion shall be discharged by no other officer.
2. All acts and parts of acts in conflict with this act are
hereby repealed.
3. This act shall be in force from its passage.
