Chap. 359.—An ACT to exempt the Property of the Husband or Wit
from the Ante-Nuptial Debte of the other.
* Approved March $1, 1875.
1. Be it enacted by the general assembly, That the real
and personal property of any female, and the rents, iasues
and profits arising therefrom, and which she shall own at
the time of marriage, or which she shall acquire after the
marriage from any source other than from the husband, shall
not be liable for the debts of her husband contracted before
marriage; nor shall the said property be liable for any con-
tract, obligation, debt or undertaking made or entered into
in renewal of or based upon a consideration arising or exist-
ing before the marriage.
2. That all the property of the wife acquired after the
passage of this act, by gift, grant, devise, or bequest, from
any suurce other than from her husband, shall also be sub-
ject to the provisions hereof, although said marriage was
solemnized before the passage of this act.
3. An action or suit may be maintained against the hus-
band and wife jointly for any debt of the wife contracted
before marriage; but the execution on any judgment or
decree in euch action or suit shall issue against, and such
judgment or decree shall only bind, the estate and property
of the wife which sbe shall own at the timo of marriage, or
acquire subsequently thereto, and not that of the husband.
4. This act shall be in foree from its passage.
