Chap. 962.—An ACT to amend and re-enact independent section 11 of an
act entitled “an act to amend and re-enact sections 2131, 2133, 2134, 2135,
2137, 2148, 2151, 2153, and to repeal sections 2141, 2142, 2143, 2144, 2145,
2147 of chapter 97, of the code of Virginia, in relation to oysters, and to add
independent sections thereto, approved February 25, 1892, as amended and
re-enacted by chapter 831 of the acts of 1895 and 1896, approved March 5,
1896,” as further amended and re-enacted by chapter 241 of the acts of
1899 and 1900.

1. Be it enacted by the general assembly of Virginia, That chapter
two hundred and forty-one of the acts of assembly of eighteen hundred
and ninety-nine, nineteen hundred, entitled “an act to amend and
re-enact section eleven of an act entitled an act to amend and re-enact
section twenty-one hundred and thirty-one, twenty-one hundred and
thirty-three, twenty-one hundred and thirty-four, twenty-one hundred
and thirty-five, twenty-one hundred and thirty-seven, twenty-one hun-
dred and forty-eight, twenty-one hundred and fifty-one, twenty-one hun-
dred and fifty-three, and to repeal sections twenty-one hundred and
forty-one, twenty-one hundred and forty-two, twenty-one hundred and
forty-three, twenty-one hundred and forty-four, twenty-one hundred
and forty-five, and twenty-one hundred and forty-seven of chapter
ninety-seven of the code of Virginia, in relation to oysters, and to add
independent sections thereto, approved February twenty-fifth, eighteen
hundred and ninety-two, as amended and re-enacted by chapter eight
hundred and thirty-one of the acts of eighteen hundred and ninety-
five and eighteen hundred and ninety-six, approved March fifth, eighteen
hundred and ninety-six, approved February third, nineteen hundred,”
approved March third, nineteen hundred, be further amended and
re-enacted so as to read as follows:
§ 11. All oysters taken from any rock beds, or shoals, in the waters
of this state, except on the eastern side of Accomac and Northampton
counties, shall be culled on their natural beds, rocks, or shoals as taken,
and oysters whose shells measure less than three inches in length,
measuring from hinge to mouth, and all shells shall be included in said
culling and replaced upon said rock, bed, or shoal: provided, that
ovsters once passed from the culling board to the inside of the boat
less than the prohibited size, and all shells, shall be considered as not
having been culled according to the provisions of this act: provided,
that when small oysters are adhering so closely to the shell of the
marketable oysters as to render its removal impossible without de-
stroving the young oyster, then it shall not be necessary to remove it.
And it shall be unlawful for any person to take, buv, or sell the small
ovsters and shells so taken as aforesaid from the natural rocks, beds,
and shoals as aforesaid. Any person violating the provisions of this
act, either by removing from the said rocks, beds, or shoals, or bv
buying or selling oysters less than three inches in length, from hinge
to mouth, or shells as hereinbefore mentioned, shall be deemed guilty
of a misdemeanor, and, on conviction thereof, shall be fined not less
than ten dollars nor more than one hundred dollars: provided. how-
ever, that so much of this section as prohibits the catching and taking
of oysters whose shells measure less than three inches, from hinge to
mouth, shall not apply to James river above a line drawn from Day’s
point, in the county of Isle of Wight, in Deep creek, in the county of
Warwick.
2. All acts and parts of acts in conflict with this act are hereby
repealed.
3. This act shall be in force from its passage.
