Chap. 784.—An ACT to amend and re-enact section 2105 of the code in relation
to fish ladders, as amended and re-enacted by an act entitled an act to
amend and re-enact section 2105 of the code of 1887, touching fish ladders,
approved January 14, 1900. .

1. Be it enacted by the general assembly of Virginia, That section
twenty-one hundred and five of the code, as amended and re-enacted by
an act entitled an act to amend and re-enact section twenty-one hundred
and five of the code of eighteen hundred and eighty-seven, touching
fish-ladders, approved on the fourteenth day of January, eighteen
hundred and ninety, be amended and re-enacted so as to read ag
follows:
§ 2105. Dams and so forth; to be provided with “ McDonald Fish-
way.”—Any person or corporation owning or having control of any dam
or other obstruction in any of the rivers of this state above tide-water,
which may interfere with the free passage of fish, shall provide every
such dam or other obstruction with a suitable fish-ladder so that fish
may have free passage up and down said rivers during the months of
March, April, May, and June of each year, and maintain and keep the
same in good repair, and restore it in case of destruction: provided, how-
ever, that this section shall not apply to the Meherrin river, within the
county of Brunswick.
2. This act shall not be construed as requiring fish-ladders to be
placed on any dam now exempt by law.
3. This act shall be in force from its passage.
