Chap. 364.—An ACT to amend chapter 128, acts of 1897 and 1898, entitled an
act for the protection of partridges in the county of Roanoke.

1. Be it enacted by the general assembly of Virginia, That chapter
one hundred and twenty-eight, acts of eighteen hundred and ninety-
seven and eighteen hundred and ninety-eight, entitled an act for the
protection of partridges in the county of Roanoke, approved January
twenty-sixth, eighteen hundred and ninety-eight, be amended and re-
enacted so as to read as follows:
§ 1. Be it enacted by the general assembly of Virginia, That it shall
be unlawful for any person to kill or capture in any way or offer for sale
in Roanoke county any partridges (or quail) between the first day of
January and the first day of November of each year, or to capture the
same in traps or nets, or on the snow at any time, or to take or destroy
the eggs of the same at any time. Any person violating any of the pro-
visions of this act shall be deemed guilty of a misdemeanor, and upon
conviction thereof shall be fined ten dollars for each offense and im-
prisoned in the county jail until the fine be paid, but not exceeding
thirty days. In any prosecution of a person for a violation of any of
the provisions of this act, proof of the possession of any such birds or
eggs shall be prima facie evidence of guilt.
2. All acts and parts of acts in conflict with this act are hereby
repealed.
3. This act shall be in force from its passage.
