Chap. 238.—An ACT to repeal section 8 of an act approved February 11, 1898,
entitled an act to amend and re-enact chapter 598 of the acts of the general
assembly of Virginia, approved March 8, 1894, entitled an act in relation
to making and keeping in repair the roads and bridges of Alexandria
county, as amended by an act approved March 38, 1896, and to prohibit the
use of money derived from the sale of bonds under an act approved Decem-
ber 19, 1899, from being used in the construction, making, or opening new
roads, and providing that all work done and materials required upon the
said roads shall be by contract after advertisement, and the same let to the
lowest responsible bidder; and to authorize the board of supervisors to levy
a tax not exceeding fifty cents upon the one hundred dollars’ value of such
property; and providing how the money derived from the sale of the said
bonds, under the act approved December 19, 1899, shall be expended and
apportioned among the magisterial districts of the county, and to authorize
the board of supervisors to employ a competent civil engineer, and to
authorize the judge of the county court to appoint a board of audit, and to
prescribe their duties.

Whereas by an act approved December nineteenth, eighteen hundred
nd ninety-nine, entitled an act to authorize the board of supervisors of
lexandria county to borrow money by the issue of bonds, to repair
nd improve the public roads of the said county, and to authorize the
ualified voters of the said county to vote on the question; and
Whereas in the event of such bonds being issued by reason of a vote
f the qualified voters as therein provided, it will be necessary to expend
ich moneys derived from the sale of the said bonds; and
Whereas it is desired to leave in force and effect the present road law
ith the exceptions as hereinafter provided; and
Whereas it is desired to provide special legislation regulating the
xpenditure of the sum of money derived from the sale of said bonds;
1erefore, ,
1. Be it enacted by the general assembly of Virginia, That section
ight of an act approved February eleventh, eighteen hundred and
inety-eight, entitled an act to amend and re-enact chapter five hundred
nd ninety-eight of the acts of the general assembly of Virginia, ap-
roved March third, eighteen hundred and ninety-four, entitled an act in
2lation to working and keeping in repair the roads and bridges of
lexandria county, as amended by an act approved March third, eigh-
2en hundred and ninety-six, be, and the same is hereby, repealed.
2. No money derived from the sale of the bonds shall be used in the
onstruction or making or opening of new roads in the county.
3. That all work to be paid for out of the money derived from the sale
f the bonds shall be by contract, upon such terms as the board of super-
isors may prescribe, and in letting of such contract the said board shall
ause to be posted in the most public and conspicuous place, at each
ost-office in the county of Alexandria, at least two weeks before the
otting of said contract, and advertise in the Alexandria county papers,
nd one in Alexandria and Washington for two weeks, a notice of the
roposed letting of said work, and written bids therefor shall be invited.
‘he plans and specifications of said work and the estimates of the kind
nd quantities of said work, and all materials required, shall be accessi-
ble to all bidders at least ten days before the letting; said bids shall be
filed with the chairman of the board of supervisors, and they shall be
kept unopened until the first regular or called meeting of the said board
after the completion of the advertisement for bids, at which time said
bids shall be opened in the presence of bidders, and the contract for
said work or materials shall be awarded to the lowest responsible bidder,
the said board having the right to reject any or all bids and give the
preference, all things being equal, to the residents of Alexandria county.
The successful bidder shall give bond to the amount of the contract,
approved iy the board, within ten days after the awarding of the con-
tract, and before commencing work. During the progress of the said
work the board of supervisors are authorized to pay for the same
upon estimates furnished by the civil engineer, the board retaining for
the period of six months twenty per centum of said estimates as an addi-
tional security for the faithful performance of the contract until said
work has been completed and approved by the civil engineer and board
of a and accepted by the board of supervisors.
The board of supervisors shall annually levy a tax upon the prop-
ont real and personal, assessed for taxation in the county not execeding
fifty cents upon every one hundred dollars in value of such property, and
the same shall be collected and paid out on the warrant of the board as
if it were a county levy, except so much thereof as may be necessary to
meet the requirements of section eight of an act approved December
nineteenth, eighteen hundred and ninety-nine, to authorize the board
of supervisors of Alexandria county to borrow money by the issue of
bonds, to repair and improve the public roads of said county, and to
authorize the qualified voters of said county to vote on the question.
5. The board of supervisors are authorized to employ a competent
civil engineer whose compensation and duties shall be determined by the
board. He shall have sole charge, and he shall see that no piece of
road is improved until it is properly graded.
All money derived from the sale of said bonds shall be expended
upon the roads in the three magisterial districts in the following pro-
portion: Fifty thousand dollars for Jefferson, sixty thousand dollars for
Arlington, and forty thousand dollars for W ashington’ district.
%. The judge of the county court of Alexandria ‘county shall appoint
a board of audit consisting of three residents of Alexandria county, one
from each magisterial district, whose duty it shall be ta examine and
audit the accounts and vouchers of the said board of supervisors relating
to the expenditure of the money received from the sale of the said bonds
and make report of the same to said judge, and it shall be their duty
to examine and approve all work done upon the roads, which is paid
for out of the funds derived from the sale of said bonds, and said board
shall report their action to the said judge, said report shall be opened
to the inspection of the public.
All moneys realized from the sale of said bonds to be deposited
in a national bank to the credit of the board of supervisors and all dis-
bursements on account of said road improvement to be made by check
on said bank, signed by the board of supervisors.
9. The bonds and coupons issued under this act shall be redeemable
at the said bank of deposit and by that bank duly cancelled when paid.
All appropriations of money from the collection of taxes received by
the treasurer of Alexandria county to pay said coupons and bonds shall
be promptly deposited in said national bank by said treasurer. The
issue of said bonds shall only be made as the money is needed in paying
for work done.
10. The money derived from the sinking fund shall be deposited in
such responsible incorporated savings bank or trust company, being in
existence prior to this act, as shall pay not less than three per centum
per annum upon such deposit, and as may be approved by any three of
the sinking fund commission. Said sinking fund commission shall be
required to give a joint bond in the sum of ten thousand dollars.
11. This act shall not become operative until the qualified voters, as
provided in an act approved December nineteenth, eighteen hundred
and ninety-nine, to authorize the board of supervisors of Alexandria
county to borrow money by the issue of bonds, to repair and improve the
public roads of said county, and to authorize the qualified voters of the
said county to vote on the question, have voted upon and adopted the
said act, approved December nineteenth, eighteen hundred and ninety-
nine, entitled an act to authorize the board of supervisors of Alexandria
county, to borrow money by the issue of bonds to repair and improve the
public roads of said county, and to authorize the qualified voters of
said county to vote on the question.
12. All acts and parts of acts in conflict with this act are hereby re-
pealed.
