Chap. 164.—An ACT to empower the counties of Albemarle, Buckingham,
and Fluvanna to construct a bridge across James river, at or near the town
of Scottsville, and to collect tolls thereon, and to authorize and empower
said counties to negotiate a loan and issue bonds for that purpose, and to
repeal section 1388 of the code of Virginia in so far as it applies, to such
ridge.

_1. Be it enacted by the general assembly of Virginia, That the
counties of Albemarle and Buckingham be, and they are hereby, author-
ized and empowered to construct or aid in constructing a bridge suitable
for wagons and other vehicles across James river at or near the town of
Scottsville.
2. The determination to erect and the amount of the expenditure
necessary for the construction of said bridge, and the proportions
thereof to be paid by each of said counties shall be determined and
allowed, as provided by sections nine hundred and forty-five, nine hun-
dred and fifty-six, nine hundred and eighty-nine, and nine hundred
and ninety, of the code of Virginia of eighteen hundred and eighty-
seven.
3. Said bridge may, in the discretion of the courts of said counties,
be so constructed as that its terminus on the northern side of said
river shall be in the county of Fluvanna, and whether such terminus be
in Fluvanna or Albemarle county, the county of Fluvanna is hereby
authorized to unite with said counties of Albemarle and Buckingham,
and to aid in the construction of said bridge; the amount of expenditure
for that purpose by the county of Fluvanna to be determined and
allowed, as provided by sections nine hundred and forty-five and nine
hundred and fifty-six of the code of Virginia of eighteen hundred and
eighty-seven.
4. For the purpose of raising the money to make such expenditure,
or any part thereof, after the same shall have been allowed and deter-
mined, as provided for in the preceding sections of this act, and the acts
therein referred to, each of said counties is hereby authorized to issue
its recistered or coupon bonds for the respective amounts to be raised
by each, or any part thereof, bearing interest at a rate not greater than
five per centum, payable semi-annually, which bonds shall be issued by
the board of supervisors of each respective county, and shall be signed
by the chairman and attested by the clerk of such board of supervisors,
and shall be in such denominations and pavable at such time or times
as the board of supervisors of the county issuing the same may direct.
The county courts of the counties contributing towards the con-
struction of said bridge may, in the discretion of said courts, In which
the courts of said counties shall coneur, require that tolls shall be paid
for the passage and transportation of persons and property across said
bridge, the rates of such tolls to be fixed, and may be changed from time
to time by the county courts of said counties. And in that event the
county courts of said counties shall make such provisions as may be
necessary for the collection of and accounting for such tolls, and the
compensation to be paid therefor: and after deducting the costs of
collecting said tolls the residue shall be paid into the treasuries of such
counties in proportion to the amounts contributed by each towards the
construction of said bridge, and shall be applied to the purposes of each
respective county as may be ordered and directed by the board of super-
visors thereof. But in no event shall the citizens or frecholders of
anv county which has contributed as much as five hundred dollars
towards the construction of said bridge be required to pay toll for pas-
sage or transportation across said bridge of themselves, their families,
employ ees or property.
6. The county courts of each of said counties are hereby authorized
to appoint a special commissioner or commissioners of such court for
the purpose of soliciting, contracting for and collecting subscriptions
and donations from private individuals, partnerships, and corporations.
to be used in the construction of said bridge, and any contract made by
any individual, partnership or corporation with any such commissioner
or commissioners for anv such subscription or donation shall be binding
upon the party agreeing to make such subscription or donation, and
such contract. shall be enforcible and collectible, and suit or suits may be
maintained thereon for that purpose in the name of the commissioner
or commissioners with whom the same is made, for the benefit of the
counties constructing such bridge. And the county court of the county
appointing anv such commissioner may in its diseretion require such
conmissioner to execute a bond before such court, conditioned for the
faithful performance of his duty as such commissioner, in such a penalty
as such court may preseribe, and with security to be approved by such
court. And all sums collected or received under this section shall he
paid by the commissioner collecting the same into the treasury of the
county in which such commissioner was appointed, and shall be used
and paid out on the order of the board of supervisors of such countv
in the construction of such bridge, and if not so used, shall be returned
to the person from whom the same was collected or received. No com-
missioner appointed hereunder shall receive anv compensation for his
services hereunder unless the same shall be expressly allowed by the
court by which he is appointed, and each commissioner appointed here-
under shall report all his transactions as such to the court by which
he was appointed.
7. All acts or parts of acts inconsistent herewith are hereby repealed,
and section thirteen hundred and eighty-eight of the code of Virginia
of eighteen hundred and eighty-seven shall not apply to the bridge
hereby authorized to be constructed, and to that extent is hereby re-
pealed. .
8. This act shall be in force from its passage.
