Chap. 1047.—An ACT to incorporate the town of Holland, in the county of
Nansemond.
Approved March 7, 1900.
1. Be it enacted by the general assembly of Virginia, That all the
territory in Nansemond county contained within the following limits—
namely: Beginning at the intersection of the South Quay road with
the road leading from Quaker chureh to Carrsville, at the store of Z.
T. Holland; thence north along the Carrsville road one hundred and
forty vards; thence southwest in a straight line across the field of
A. A. Holland four hundred and fifteen vards to an iron post; thence
south in a straight line six hundred and seventy-three vards to an iren
post on the land of T. G. Jones: thence southwest in a straight line
across the South Quay road to an iron post on the south side of said
road; thence running in a parallel Ine with the northern boundary
to the road leading from the Quaker church to Carrsville; and thence
up said road north one hundred and sixtv vards to the point of the
beginning—shall constitute the town of Tolland, and the inhabitants
within the said boundaries and their suecessors shall be a corporation
under the name and stvle of the town of Holland, and the fortv-fifth
and forty-sixth chapters of the eode of Virginia, edition of cighteen
hundred and eighty-seven, as far as consistent with this act. shall he
applicable to said town; and the council of said town mav. from time
to time, enlarge the boundaries of said town by adding thereto the
Jands of such persons or corporations as may be desired to be included
in said corporation, and who shall make application therefor to the
council of said town.
2. The government of said town shall be vested in a mayor and a
council of six members besides the mayor (who shall be ex officio a
member of the council and preside at all the meetings thereof), who
shall be residents of said town, and shall be elected in the manner pro-
vided by the law of Virginia then existing on the fourth Thursday in
May, one thousand nine hundred and two, and on the fourth Thursday
in May in every second year thereafter, by those qualified to vote for
the members of the general assembly and who shall have been residents
within the boundaries of the said corporation for three months next
preceding the election and by no other persons. The mayor and council
shall enter on the discharge of their duties on the first day of July,
next following their election, and shall remain in office until their
successors are elected and qualified in their stead, but no longer.
3. The council shall appoint annually a sergeant and recorder, fix
their compensations, and prescribe their duties and require such bond
as mav be deemed proper.
4. The sergeant of the said town shall have the power to collect the
fines imposed for violation of any of the ordinances of the corporation,
and the said sergeant shall have the power to exercise within the cor-
porate limits of said town, and within one mile thereof, all the duties
that a constable can legally exercise in regard to the collection of
claims and executions and levying process, and he shall be entitled
to the same compensation therefor, and he and his securities shall he
subject to the same liabilities as a constable for any failure in the per-
formance of the duties of or dereliction in his said office.
5. The mavor shall be the chief executive officer of the town; he
shall take care that the by-laws, ordinances, acts, and resolutions of
the council are faithfully executed; he shall be ex officio a conservator
of the peace within the town and within a mile of its corporate limits,
and shall, within the same, exercise all the powers vested in the justice
of the peace for the county; he shall have control of the police of
the town, and may appoint special police officers when he deems it
necessary; he shall have authority to issue his warrant for the arrest
of any person or persons violating any of the ordinances, acts, or reso-
lutions of said town; it shall be his duty especially to see that peace
and good order are preserved, and that persons and property are pro-
tected in the town: he shall have power to issue executions for all fines
and costs imposed by him, or he may require the immediate payment
thereof, and in default of such payment he mav commit the partv in
default to the jail of Nansemond county until the fine and costs shall
be paid, but the term of imprisonment shall not exceed thirty davs:
he shall, from time to time, recommend to the council such measures as
he may deem needful for the welfare of the town; he shall receive a
compensation for his services, to be fixed by the council, which shall
not he increased nor diminished during the term for which he shall
have been elected.
6. The mavor and councilmen, and each of them, shall, and mav,
exercise all jurisdiction, civil and criminal, now by law conferred upor
the justice of the peace; shall preserve peace and good order in the
town, and to this end they, and each of them, shall be conservator:
of the peace, with all the powers conferred upon conservators of the
peace by chapter one hundred and ninety-one of the code of Virginia
‘The mayor and council of said town, and each of them, upon taking
oaths as provided herein, shall each have authority and jurisdictior
to hear and determine all matters which a justice of the peace would
have jurisdiction, and to hear and determine all controversies arising
under the laws and ordinances of said town, and to issue any and all
proper process, whether mesne or final, which may be necessary tc
enforce their judgment and authority.
The said council shall have power and authority to lav and collect.
and apply to the maintenance of public free schools in said town an-
nually a sum equal to what the inhabitants and property of said town
would have to pay annually to the county of Nansemond for public
free school purposes if this act had not been passed.
8. The said council shal] have power to make accurate bounds of
existing streets, and to compel the removal of obstructions therefrom,
and to lay off and to have new streets, allevs, and sidewalks, and to pro-
vide and protect shade trees thereon. The council of said town shall
have the same jurisdiction for condemning lands for streets. alleys, and
sidewalks of said town, as the county court has for condemning lands for
roads in the county. The council shall further have power to prevent and
provide against fire bv accident; to establish and regulate markets; to
prevent the running at large horses, dogs, hogs, and other animals; to
prevent the cumbering of streets, sidewalks and allevs, in any manner
whatsoever; to make sanitary regulations in reference to contagious
diseases, or any and all diseases: to regulate the building of all houses,
stables, privies, hog pens, and slauchter-houses; to abate nuisances at
the expense of those who caused them; to restrain and punish drunk-
ards, vagrants, mendicants, and street beggars; to appoint police and
prescribe their duties and compensations, and to make, pass, and ordain
such rules, regulations, and by-laws, as they mav deem necessary and
proper for the internal and general good, safety, health, and conve-
nience of the said town and the inhabitants thereof, and for enforcing
the provisions of the charter. Thev shall punish all violators of the
law by fine or imprisonment, or both as mav be prescribed bv the by-
laws or ordinances of said town: provided, that the accused shall have
the right to appeal to the county court in all cases of violations of the
bv-laws or ordinances of said town. The authorities of said town, with
the consent of the county court, shall have the right to use the county
jail whenever it may be needed bv them. Whenever judgment shall
be rendered against anv person for fines, and there he no visible effects
which the serceant may distrain and sell therefor, the person so in default
mav be compelled to work out such fines on the public streets or other
improvements, and to suffer in addition such term of imprisonment
as may be imposed, as provided by the ordinances of said town. All
the fines for the violation of the ordinances of said town shall be paid
into the treasury of said town, and shall be appropriated as the council
may determine.
9. The council may annually levy a tax for roads, streets, sidewalks
and all other purposes, by a two-thirds vote, to be approved by the
mayor, which on no property shall exceed that levied by Nansemond
county for county purposes. This levy shall be in addition to the
regular levy for school purposes and government of the town. The poll
tax shall not exceed fifty cents on each male person in any one year.
UY. The mayor and council and each member of the council, shall
have the power and authority to deputize any number of citizens of
the town, and such as may be in town from the county, to assist the
sergeant in the full discharge of his duties in all cases of riot and
misdemeanors.
11. In all cases in which the state may require a license to be taken
out by any person engaved in any business, trade, occupation, or calling,
or for any other purpose, the said council shall have power to require
a license to be taken out in all such eases for the benefit of said town,
before such person shall be permitted to pursue such business, trade
or calling within the corporate limits of said town, and to impose a
license on all dravs, wagons, carts, and vehicles used in hauling goods,
wares, or merchandise for hire within the limits of said town to be
delivered to any resident of said town. ‘The said council shall also
grant or refuse license to owners or keepers of wagons, drays, carts,
hacks, and other wheeled vehicles kept or emploved in said town for
hire, and may require the owner of such wagons, carts, and so forth,
using them in the town to take out a license therefor, and may require
taxes to be paid thereon and subject the same to such regulations as
they may deem proper.
12. The revenue from those and other sources shall be collected, paid
over, and accounted for at such times and to such purposes as the
council may deem fit: they mav be used for the benefit of the town.
13. The mavor and sergeant of said town shall qualify before en-
tering upon the duties of their offices in the county court of Nanse-
mond county in the manner prescribed by the law of Virginia for the
qualification of justices and constables. The bond of the sergeant to
he approved by the couneil of said town. The recorder and council-
men shall each, before entering unon the duties of their offices, make
oath or affirmation that thev will truly, faithfully, and impartially
discharge the duties of their offices, so long as thev shall continue in
office, to the best of their abilities. The said oath or affirmation shall
he taken hefore the mavor of said town.
1+. The mavor shall give no vote in the council except in case of a

The following named persons are hereby appointed to fill the
fallewwine offices until the first dav of July, in the vear one thousand
nine hundred and two. and until their successors are dulv elected and
quali fied—-namelv: TL A. Take. maver: and councilmen as follows: Doctor
JG. Tolland, J. Ee. Toland. J. R. Tolland, T. Tf. Porter. S. W. Holland,
and T. Ta. Dauehtrev. Said persons are to take their oath of office
and enter upon the discharce of their duties of their respective offices
as soon as practicable after the passage of this act. and thev are herehy
clothed with all the powers and subject to all the provisions appertaining
to their respective offices herein preseribed.
16. This act shall be in force from its passage.
