An Act to amend the Code of Virginia by adding a section numbered
46.1-192.1, relating to persons disregarding signal to stop by police
officers; providing penalties.

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding a section numbered
46.1-192.1, as follows:
§ 46.1-192.1. Any person who having received a visible or audible
signal from any police officer to bring his motor vehicle to a stop, shall
operate such motor vehicle in a wilful or wanton disregard of such signal
so as to interfere with or endanger the operation of the police vehicle or
endanger other property or person, or who shall increase his speed and at-
tempt to escape or elude such police officer, shall be guilty of reckless driv-
ing, and, upon conviction thereof shall be punished by a fine of not less
than fifty dollars nor more than one thousand dollars or by imprisonment
in jail for not less than sixty days nor more than one year, or both such
fine and imprisonment. When any person shall be convicted of reckless
driving under this section, then in addition to the penalties provided
herein, the operator’s or chauffeur’s license of such person may be sus-
pended by the court or judge for a period not to exceed one year; pro-
vided, however, in any case where the speed of the accused is determined
to have exceeded the maximum allowed by 15 miles per hour where the
maximum speed is 55 miles per hour or greater, the operator’s or chauf-
feur’s license shall be suspended by the court or judge trying the case for
a period of not less than ninety days. In case of conviction and suspen-
sion the court or judge shall order the surrender of the license to the
oe where it shall be disposed of in accordance with the provisions of
46.1-425.
