CHAPTER 599
An Act to amend and reenact § 15.1-116 of the Code of Virginia, relating
to qualifications, tenure, absence or disability and compensation of
county executive secretaries.

Be it enacted by the General Assembly of Virginia:
1. That § 15.1-116 of the Code of Virginia be amended and reenacted
as follows:
§ 15.1-116. (1) Any executive secretary so appointed shall de-
vote his full time to the work and service of the county under the
direction of the governing body, to whom he shall be accountable. He shall
be appointed with regard to merit only, and need not be a resident of the
county at the time of his appointment, but must become an actual resi-
dent of the county and in due course a bona fide resident; provided, how-
ever, that any person so qualified at the time of his appointment whose
residence shall have been annexed by a city during his tenure of office
shall not thereafter be disqualified to serve under the provisions of this
section by reason of such annexation. No member of such governing body
shall, during the term for which elected and for one year following the
expiration of such term, be appointed such executive secretary. Any per-
son, other than a member of the governing body, holding an elective office
may be appointed such executive secretary, but his qualifications shall not
be valid unless and until he shall resign his elective office.
(2) The executive secretary shall not be appointed for a definite
tenure, but shall be removable at the pleasure of the governing body.
( 3) In case of the absence or disability of the executive secretary
the governing body may designate some responsible person to perform the
duties of the office and fix the compensation, if any, for the person so
designated. An elective officer may be designated to perform such duties.
) The governing body shall fix the compensation of such executive
secretary which shall be paid in monthly installments by warrants of the
governing body.
