An Act to amend and reenact § 38.1-264 of the Code of Virginia, relating
to agreements for apportionment of certain insurance. rH 748)

Be it enacted by the General Assembly of Virginia:
Ls That § 38.1-264 of the Code of Virginia be amended and reenacted as
ollows:
§ 38.1-264. Agreements may be made among insurers with respect
to the equitable apportionment among them of insurance which may be
afforded applicants who are in good faith entitled to but who are unable
to procure such insurance through ordinary methods and such insurers
may agree among themselves on the use of reasonable rate modifications
for such insurance, such agreements and rate modifications to be subject
to the approval of the Commission; provided, however, that any such agree-
ments for equitable apportionment among them of the kind or kinds of in-
surance defined in § 88.1-17 shall include a provision for the payment of
@ service fee to the agent or agents of record in an amount of five per
centum of the total premium for such insurance.
