An Act to amend and reenact § 85-16.1 of the Code of Virginia, relating
to permits by the State Health Commissioner for the construction
of certain swimming pools; rules and regulations concerning design
and construction.

Be it enacted by the General Assembly of Virginia:
1. That § 35-16.1 of the Code of Virginia be amended and reenacted
as follows:
§ 35-16.1. No person, firm or corporation shall commence the con-
struction of any swimming pool which is to be operated in connection
with any establishment referred to in § 35-15 or any swimming pool for
the use of the public until there shall have been first obtained from the
State Health Commissioner a permit in writing signed by the State Health
Commissioner. Before issuing such permit the State Health Commissioner
or person designated by him shall examine the plans and specifications
for the proposed construction to determine whether adequate sanitation
provisions are included therein to promote the public health and safety.
The State Health Commissioner is hereby authorized to promulgate rules
and regulations as to the sanitary design and construction of such swim-
ming pools.
Upon determining that the proposed construction conforms to such
rules and regulations, the State Health Commissioner shall issue such
permit to any person, firm or corporation who shall apply therefor. No fee
shall be charged for any such permit.
