CHAPTER 37
An Act to amend and reenact 8§ 4 and 5 of Chapter 590 of the Acts of
Assembly of 1952, which provided a charter for the town of Emporia,
the sections relating to election of mayor and councilmen and appoint-
ments and elections of officers and employees of the council. HT 258)

Be it enacted by the General Assembly of Virginia:
1. That 8§ 4 and 5 of Chapter 590 of the Acts of Assembly of 1952 be
amended and reenacted as follows:
§ 4. * A mayor and nine (9) councilmen, all of whom shall be elec-
tors of the town, shall be elected at the regular municipal elections on the
second Tuesday, in June, nineteen hundred sixty-four. The mayor shall be
elected for a term of four (4) years. The four (4) council members recetv-
wing the greatest number of votes in said election shall serve as members
of the council for terms of four (4) years each. The remaining five (5)
members shall serve for terms of two (2) years each. At the regular
municipal election to be held on the second Tuesday in June, nineteen hun-
dred sixty-six and every two (2) years thereafter, councilmen shall be
elected for terms of four (4) years each. Terms of office shall begin on
the first day of September next following their elections. Each councilman
and the mayor elected as hereinabove provided shall serve for the term
stated or until his successor has been elected and qualified.
§ 5. * The council of the town shall * appoint a town manager * and
shall have power to appoint such officers, other than those provided in
this charter as it may deem necessary, and the council shall, by ordinance,
set forth the powers and duties of the town manager and also define the
duties of such other officers so appointed; the town manager may or may
not be a resident or qualified voter of the town, * and shall be under the
control of the council * and shall receive such salary as shall be allowed
him by the council and may be dismissed at any time by the council. The
council may, in its discretion, appoint one and the same person to fill both
the position of the town manager provided for in this section and the
position of town engineer provided for in § 22 of this charter. *
The council may create, appoint, or elect such other departments, bod-
ies, boards, and other officers as are hereinafter provided for, or as are
permitted, or required by law to be appointed by the council, including a
town tax assessor, whose duty it shall be to assess or value all real and
personal property subject to taxation by the town.
2. An emergency exists and this Act is in force from its passage.
