An Act to enable cities, towns and counties to provide for certain pre-
sumptions as to the disability of certain firemen caused by respiratory
diseases, hypertension or heart disease, resulting in total or partial
disability, and to base eligibility for certain benefits thereon.

Be it enacted by the General Assembly of Virginia:
1. §1. The governing body of any city, town or county may provide, by
ordinance, that any condition or impairment of health of salaried firemen
caused by respiratory diseases, hypertension or heart disease resulting in
total or partial disability shall be presumed to have been suffered in the
line of duty unless the contrary be shown by competent evidence; pro-
vided that such salaried firemen shall have successfully passed a physical
examination on entering such service, which examination did not reveal
any evidence of such condition. Such ordinance shall provide that no
therein shall be construed to extend or otherwise affect the provisions of
Title 65, Code of Virginia, relating to Workmen’s Compensation.
. Any such governing body may further provide that such pre-
sumption shall be employed in determining eligibility for retirement, sick-
ness and other benefits for persons totally or partially disabled.
