An Act to amend and reenact §§ 8, as amended, 10 and 29-a of Chapter
184 of the Acts of Assembly of 1988, being the charter of the town
of Manassas, in the County of Prince William, the sections relating,
respectively, to duties of the mayor, the town council and to justices
of the peace; and to amend said chapter by adding a section num-
bered 4-a, relating to holding of town offices by certain persons.

Be it enacted by the General Assembly of Virginia:
1. That §§ 8, as amended, 10 and 29-a of Chapter 184 of the Acts of
Assembly of 1938, be amended and reenacted; and that said chapter be
amended by adding a section numbered 4-a, as follows:
4-a. No person otherwise eligible shall be disqualified or incapable
of acting, by reason of his accepting or holding an office, post, trust or
emolument under the government of the United States, as mayor, council-
man, officer or employee of the town, or as a member, officer or employee
of any town board or commission, including the school board.
§ 8. The mayor shall preside at the meetings of the council and
perform such other duties as may be prescribed by this charter and by
pene law, and such as may be imposed by the council, consistent with
is office.
The mayor shall have no right to vote in the council except that in
every case of a tie vote of the council, the mayor shall * vote to break
the tie not later than the next regular council meeting.
The mayor shall, unless the council by resolution place the trial of
violations of town ordinances in the hands of the judge of the county
court of Prince William County, be clothed with the authority to try all
violations of any ordinance of the said town.
10. The council of the town shall be composed of * siz members.
They shall be elected by the popular vote of the qualified voters of the town,
as provided in section six hereof.
§ 29-a. The council may appoint or cause to be appointed * two
justices of the peace for the town who shall hold office during the pleasure
of the council. They shall be entitled to the same fees when taxed and
collected, and shall be limited to the same maximum compensation, as
justices of the peace for the county.
The justices of the peace for the town may at any time be removed
from office by a majority vote of the council. Upon * death, removal or
resignation of a justice of the peace, the council may appoint or cause to
be appointed a successor to hold office during the pleasure of the council.
The justices of the peace for the town shall be * conservators of the
peace for the town, and within one mile of its corporate limits. * They
shall be vested with jurisdiction, concurrent with the mayor, or vice-mayor,
to issue warrants for violations of town ordinances, acts and resolutions,
admit accused persons to bond, and fix the amount thereof, or remand them
to jail pending trial; and * they shall be vested with all the jurisdiction
or authority within the town and within one mile of its corporate limits,
under the ordinances, acts and resolutions of the town council, with which
justices of the peace for the county are vested under the laws of the
Commonwealth of Virginia.
2. An emergency exists and this act is in force from its passage.
