An Act to amend and reenact § 30-a of Chapter 94 of the Acts of 1934,
approved March 7, 1984, which section was continued in effect by
§ 4-45.1 of the Code of Virginia, and relates to local option elections
with respect to the sale of alcoholic beverages in certain towns.

Be it enacted by the General Assembly of Virginia:
1. That § 30-a of Chapter 94 of the Acts of 1934, approved March 7,
1934, which section was continued in effect by § 4-45.1 of the Code of
Virginia, be amended and reenacted as follows:
§ 30-a. Notwithstanding the provisions of § 4-45 of the Code of
Virginia, in any town having a population of less than seven hundred fifty
but more than five hundred inhabitants which is located in a county having
a population of more than fifty thousand but less than fifty-five thousand
inhabitants, and in any town having a population of more than four hun-
dred fifty but not more than five hundred inhabitants which is located
ma county having a population of more than nineteen thousand but not
more than twenty thousand two hundred fifty, all according to the last
preceding United States census, upon petition of the qualified voters of
such town, signed by not less than thirty per centum of such voters, filed
with the circuit court of the county in which the town is located, asking
that a referendum be held on the questions set forth in subsection (a) of *
§ 4-45 of the Code of Virginia, the court or judge thereof in vacation shall
by order of record require the regular officials of the county on a day fixed
in the order not less than sixty nor more than ninety days from the date
of the order to open the polls and take the sense of the qualified voters
of the town on the questions to be submitted under this section and *
§ 4-45 of the Code of Virginia. No election hereunder shall be held on the
day any other election is held in the town or in any year in which there
is an election in the county for the election of a Commonwealth’s attorney,
treasurer and commissioner of the revenue or any of them. In all respects
elections under this section shall be called and conducted and the results
thereof ascertained in conformity with the provisions of * § 4-45 of the
Code of Virginia except as they are superseded by this section.
