summoning of petit jury in criminal cases. Ss 208

Be it enacted by the General Assembly of Virginia:
ta That § 19-171 of the Code of Virginia be amended and reenacted as
ollows:
§ 19-171. The writ of venire facias in case of felony shall command
the officer to whom it is directed to summon twenty persons of his county
or corporation, to be taken from a list furnished him by the clerk issuing
the writ, who are qualified in all respects to serve as jurors, to attend the
court wherein the accused is to be tried on the first day of the next term
thereof or at such other time as the court or judge may direct; provided,
however, the court shall not charge the grand jury in the presence of
any person so summoned who shall be selected as a juror to try any person
indicted by said grand jury. A violation of this provision shall constitute
reversible error in any criminal case which is tried by a jury composed of
one or more such veniremen.
