An Act to amend and reenact §§ 9.10, as amended, 9.11 and 9.18 of
Chapter 586 of the Acts of Assembly of 1950, approved April 7, 1950,

Be it enacted by the General Assembly of Virginia:
1. That §§ 9.10, as amended, 9.11 and 9.13 of Chapter 536 of the Acts
of Assembly of 1950, approved April 7, 1950, be amended and reenacted,
as follows:
§ 9.10. The regulations and restrictions shall be enacted with rea-
sonable consideration, among other things, of the character of each zone
and its peculiar suitability for particular uses, and with a view of conserv-
ing the value of land, buildings, and structures and encouraging the most
appropriate use thereof throughout the city. Except when a comprehen-
sive zoning plan is adopted or amended as a whole, no change in zone
boundaries shall be made so as to include less than * one block, but such
change need not include * that frontage which is within one hundred feet
of the street line of * an intersecting street *, and in blocks with a *
frontage * of seven hundred fifty feet or more the change need not
include more than five hundred continuous feet thereof. * The specific
requirements of this section shall not apply when the change consists of:
(a) the rezoning of land in a block to the same zone as that of the major
portion of the block, if such major portion constitutes all the balance of
the block; (b) the inclusion of the balance of a contiguous parcel in single
ownership in the same zone in which the major portion of such parcel is
already included; provided, however, that such * change does not extend
more than fifty feet beyond the original zone boundaries and provided
that a further extension of an already extended zone in single ownership
shall not be granted in the two-year period following the original zone
change; (c) the rezoning of land with frontage which is abutted on both
sides by less restrictively zoned land when the change is to a zone not
less restrictive than that on either side; and (d) changes in zone boun-
daries of areas in excess of five acres. In any change in zone boundaries
designating two or more areas to be different zones, each such area con-
stituting a separate zone must conform to the requirements of this
section. The word “block” as used in this section shall mean land fronting
along one side of a dedicated public street either in excess of seven hun-
dred and fifty feet or between two dedicated intersecting public streets or
of thee dedicated intersecting public street and the corporate limits
of the city. ,
§ 9.11. It shall be the duty of the city planning commission to pre-
pare and submit to the council a comprehensive zoning plan as referred to
in § 9. * 09 of this chapter and from time to time at intervals not exceed-
ing * five years prepare and submit such changes in or revisions of the
said plan as changing conditions may make necessary.
§ 9.18. If a protest is filed with the city clerk against such amend-
ment, supplement or repeal as stated in § 9.12, signed by the owners of.
twenty per cent or more either of the * area of * land within the boun-
daries of such proposed change or of the * area of * land within * three
hundred feet of * the boundaries of such proposed change, the council
shall not adopt the ordinance making such amendment, supplement or
repeal, by less than three-fourths affirmative votes of the members of
council. Streets, alleys and lands dedicated to public use or lands owned
by the city, State or federal government shall not be included in comput-.
ing the above-mentioned areas. :

For payment of unemployment benefits as authorized by
the Virginia Unemployment Compensation Act, a sum
sufficient, estimated at ooo. $14,000,000
each year.
It is hereby provided that this appropriation for
payment of unemployment benefits shall be paid only
out of the monies requisitioned from the State of
Virginia’s account in the unemployment compensa-
tion trust fund in the treasury of the United States,
and paid into the State treasury to the credit of the
unemployment compensation fund in accordance with
the provisions of §§ 60-90 through 60-94, inclusive, of
the Code of Virginia, and not out of the general fund
of the State treasury.
Item 121
For payment of unemployment benefits for Federal em-
ployees and veterans on behalf of the Federal gov-
ernment, a sum sufficient.
It is hereby provided that this appropriation for
payment of unemployment benefits for Federal em-
ployees and veterans shall be paid only out of monies
paid by the Federal Government into the Federal
benefits fund of the State treasury, and not out of
the general fund of the State treasury.

For special unemployment compensation expenses to be
paid only out of the Special Unemployment Com-
pensation Administration Fund continued in effect by
§ 60-95 of the Code of Virginia, a sum sufficient, not

For refund of contributions and interest thereon in ac-
cordance with the provisions of § 60-94 of the Code

For payment to the Secretary of the Treasury of the
United States to the credit of the unemployment
compensation trust fund established by the Social
Security Act, to be held for the State of Virginia
upon the terms and conditions provided in the said
Social Security Act, there is hereby appropriated the
amount remaining in the clearing account created by
§ 60-90 of the Code of Virginia after deducting from
the amounts paid into the said clearing account the
refunds payable therefrom pursuant to § 60-94 of the
Code of Virginia.

ever, with approval of the Governor, loans for the

It is provided that this reappropriation may be ex-
pended with the approval of the Governor and the
State Highway Commission, for the acquisition by
purchase, gift or condemnation of lands lying within
the State of Virginia and within the boundaries of
the proposed George Washington Memorial Parkway
from the present terminus of the Parkway to the
proposed Virginia-Washington Circumferential road-
way at Cabin John in Fairfax County, Virginia, and
no further. This reappropriation being based on an
estimate submitted to the Department of Officials of
the National Capitol Park Planning Commission. It is
further provided that this reappropriation, with the
approval of the Governor and the State Highway
Commission, may be expended directly for the acquisi-
tion of such lands, or the Governor may place
the entire appropriation, or any part. thereof,
at the disposal of the United States of America, for
the acquisition of the said lands for the establishment
of the proposed George Washington Memorial Park-
way.
It is further provided, however, that this reappro-
priation shall be expended or placed at the disposal
of the United States of America or its duly author-
ized officers or agents for the acquisition of said lands
only when satisfactory proof is furnished the Gov-
ernor that an equivalent sum has been provided for
the same purpose by the political subdivisions adja-
cent to the proposed George Washington Memorial
Parkway; and provided, further, that this reappropria-
tion is not to be considered as obligating the State
to make further appropriations for the establishment
of the aforesaid Parkway except as future General

allocated to the counties and cities on the basis of

tain sums, revenues and taxes to the schools of the
primary and grammar grades. It is further provided
that the appropriations made in Items 355, 360, 363,
and 364 are in discharge of the directions to the
General Assembly contained in Section 129 of the
Constitution of Virginia. It is further provided that
all other appropriations herein made to the State
Board of Education for school purposes are solely
in discharge of the permissive authority conferred

It is hereby provided the State Board of Education
shall administer, in the place of the State Council for
Higher Education, the loans and scholarships granted
pursuant to Item 180-A of Chapter 642, Acts of
Assembly of 1958, as amended. The State Board of
Education is hereby empowered, with the prior writ-
ten approval of the Governor, to amend the rules and
regulations heretofore adopted by the Council relative
to these loans and scholarships.
It is further provided that any unexpended balance
at the close of the current biennium in the cited
Item 180-A shall be reappropriated and added to Item
358; and that any repayment of monies from the
appropriation made by the cited Item 180-A shall be
added to the appropriation in Item 358.

It is provided that in the apportionment of this
sum, the sums which have been or will be received by
the respective Counties and Cities under Items 365
and 866 shall be considered as if they had been re-
ceived under this item.
It is provided, further, that the total of this sum
shall be apportioned to the public schools by the State
Board of Education under rules and regulations pro-
mulgated by it to effect the following provisions:
a. The apportionment shall be on the basis of the
following amounts, as applicable, per State aid
teaching position:
(1) for each such position added after July 1,
1960, 75% of the salary paid the incumbent of a
State aid teaching position pursuant to the salary
schedule established under paragraph (f) below.
(2) for each other State aid teaching position
which is occupied by a teacher having a col-
legiate professional certificate (or equivalent)
and eight or more years of experience or by a

It is provided, however, that no payment from
this item for a State aid teaching position shall
exceed two-thirds of the salary paid the incumbent
of a State aid teaching position when the total
salary of such incumbent is less than the amount
of State aid available for each State aid teaching
position. For purposes of this act, “State aid teach-
ing position” is defined as one teaching position for
each thirty (80) pupils in average daily attendance
in the elementary grades and one teaching position
for each twenty-three (23) pupils in average daily
attendance in the high school grades. The average
daily attendance figures used in the apportionment
of this item shall be those of the school year falling
within the fiscal year for which the appropriation
is made.
b. No apportionment from this item shall be
made to any county or city for State aid teaching
positions in excess of the number of such positions
in which teachers are actually employed: provided,
however, that in exceptional circumstances and in
the discretion of the State Board of Education, a
county or city may employ fewer teachers than the
number of assigned State aid teaching positions
allotted in accordance with paragraph a.
c. No apportionment from this item shall be
made to any county or city except for payment of
salaries of teachers or other instructional personnel
in the public schools, or for payment of tuition in
lieu of teacher or other instructional salaries under
rules and regulations of the State Board of Edu-
cation.
d. The annual expenditure of funds, derived from
local sources, for instruction in the public schools
shall not be less than the annual expenditure
made from local sources for such instruction for
the second school year in the previous biennium.
However, if a county or city has established and
maintains a salary schedule for teachers and other
instructional personnel satisfactory to the State
Board of Education, the expenditure, derived from
local funds, for the salaries of teachers and other
instructional personnel may be reduced below such
expenditures for the second school year in the
previous biennium, provided the reduction and
the amount of reduction are approved by the State
Board of Education. Also, a county or city may
reduce such expenditure in exceptional circum-
stances due to a substantial loss in average daily

attendance of pupils in the county or city, or in
other exceptional local conditions, provided the re-
duction and the amount of reduction are approved by
the State Board of Education.
e. The county or city shall pay from local funds
at least thirty per cent (30%) of the total amount
expended for salaries of teachers and other in-
structional personnel. However, a county or city
shall be permitted by the State Board of Edu-
cation to pay not less than twenty per cent (20%)
of such amount if the county or city provides a levy
or cash appropriation or a combination of both for
schools, which, when converted to an equivalent
true tax rate, is as great as the average of all
county or all city levies or cash appropriations or
a combination of both such levies and appro-
priations for schools converted to an equivalent
true tax rate; in converting a levy or cash appro-
priation or a combination of both for schools to
an equivalent true tax rate, ratios of assessed
valuations to true values used shall be such ratios
determined by the State Tax Commissioner for the
tax year 1950. For such counties or cities, the
State Board of Education shall determine the per
cent of local contribution, in no instance less than
twenty per cent (20%) of the total amount ex-
pended for salaries of teachers and other instruc-
tional personnel.
f. A minimum salary schedule for teachers and
other instructional personnel, satisfactory to the
State Board of Education and approved by the
Governor, shall be put into effect.
g. If any municipality annexes any portion of
any county or counties, the State Board of Educa-
tion shall make such equitable adjustment of the
funds which would otherwise have gone to either
as is in its opinion justified by the peculiar condition
created by such annexation, and order distribution
of such funds according to its findings. This provi-
sion shall not apply if a court of competent juris-
diction makes such adjustment and orders such dis-
tribution.
h. Allotments of funds from this item shall be
paid to a county or city only after submission of
evidence satisfactory to the State Board of Edu-
cation that the amount for which the allotment is
claimed has been or will be expended for the pur-
pose designated and in full compliance with the
terms and conditions set forth pursuant to this item.
i. It is further provided that the State Board of
Education with the approval of the Governor may
make such equitable adjustment in the distribution
of this fund as may be necessary due to a sub-
stantial loss in average daily attendance of pupils
in any county, city or town. The average daily
attendance data for such county, city or town for
the previous year may be used in making this ad-
justment.
It is further provided that in the event the total
of the sums set forth in Items 365, 366 and 367 ex-
ceeds the amount necessary to make the apportion-
ments required by this item, any balance remaining
may, upon request by the State Board of Education,

Education shall make no distribution from this item
to any county or city which has not first complied
with the conditions stated in paragraphs c-h, inclu-
sive, of Item 867 and in paragraph b of Item 3869.

A county or city, which meets the requirements
stated below is eligible, subject to rules and regula-
tions promulgated by the State Board of Education,
to receive an apportionment from this item to provide
sufficient monies to operate a minimum educational
program; a minimum educational program is defined
as expenditure for school operation of not less than
one hundred and seventy dollars nor more than two
hundred dollars, as promulgated by the State Board
of Education, per pupil in average daily attendance.
To be eligible for an apportionment from this item,
a county or city must:
a. Have projected, in the opinion of the State
Board of Education, a well-planned educational pro-
gram, and
b. Have expended from local sources for school
operation, exclusive of capita] outlay and debt serv-
ice, an amount equivalent to a uniform tax levy of
fifty cents per one hundred dollars ($100) of true
valuation of loca] taxable wealth within such county
or city. The true valuation of local taxable wealth
used for this purpose shall be that determined by
the State Department of Taxation for the tax year
1950.
c. Be still unable, with the amount thus provided
from local sources, other available State apportion-
ments for the public free schools, and Federal funds
(not including capital outlay), to provide a mini-
mum education program as defined above.
It is further provided that the State Board of
Education may, in its discretion, apply eligibility
requirements and compute allocations from this
fund separately for any town school district oper-
ated by a school board of not more than five mem-
bers, and the county in which such town is located.
If the amounts set forth in Items 865-367, inclu-
sive, are not sufficient for the purposes described
therein, the State Board of Education with the prior
written approval of the Governor, may transfer to
Item 367 from this Item, such sums as may be deemed
proper.
If the amount provided by this item is insufficient
to meet the entire needs of those counties and cities
which qualify for apportionments as herein provided,

cities on a pro rata basis.
No county or city shall receive from the total ap-
propriation under this item more than two hundred
and fifty thousand dollars during either year of the
current biennium.

this appropriation will enable the schools in said
county to be operated and maintained for a term of
not less than nine months.
(2) For the purpose of aiding those counties
and/or cities which are experiencing extraordinary
continuing increases in average daily attendance,
thereby requiring employment of additional teachers
in excess of the number anticipated on the basis of
average daily attendance of pupils enrolled during
the preceding school year.

years of age, either of whose parents was a citizen
of Virginia at the time of entering war service and
was killed in action or died from other causes in

corps, air force or coast guard of the United States,
either of whose parents was, or is, or may he
become totally and permanently disabled due to such
service during either such period, whether such
parents be now living or dead.
Such children, upon recommendation of the Super-
intendent of Public Instruction, shall be admitted
to State institutions of secondary or college grade,
free of tuition.
The amounts that may be, or may become, due here-
under by reason of attendance at any such educa-
tional or training institution, not in excess of the
amount specified hereinafter shall be payable from
this appropriation hereby authorized on vouchers ap-
proved by the Superintendent of Public Instruction.
The Superintendent of Public Instruction shall
determine the eligibility of the children who may
make application for the benefits provided for herein;
and shall satisfy himself of the attendance and satis-
factory progress of such children at such institutions
and of the accuracy of the charge or charges sub-
mitted on account of the attendance of any such chil-
dren at any such institution, provided, that neither
said Superintendent nor any member of the State
Board of Education, nor any official or agent or em-
ployee thereof, shall receive any compensation for
such services.
Not exceeding four hundred dollars shall be paid
hereunder for any one child for any one school year;
and no child may receive benefits of this or similar
appropriations for a total of more than four school
years.
This amendment shall not operate to divest any
such child of any such scholarship now holding any
such scholarship under this act except that the four-
year limitation herein provided for shall apply to any
scholarship heretofore issued.
