CHAPTER 597
An Act authorizing Eastern State Hospital to convey certain real estate
to The College of William and Mary in Virginia and to further author-
ize The College of Wiliam and Mary in Virginia to negotiate with
Colonial Williamsburg, Incorporated, for the exchange of certain real
estate and with the approval of the Governor to consummate the sale
thereof and to provide for disposition of the proceeds of such sale.

Be it enacted by the General Assembly of Virginia:
1. § 1. Subject to the approval of the Governor in writing first ob-
tained, Eastern State Hospital is hereby empowered to convey by deed, in
form approved by the Attorney General, to The College of William and
Mary in Virginia the following described property:
(1) All that certain lot or parcel of land, together with the buildings
and improvements thereon, situate in the City of Williamsburg, Virginia,
and bounded and described as follows: On the North by Ireland Street,
7714 feet; East by South Henry Street, 112 feet; South by the lot belong-
ing to Minerva Pickett’s estate; and West by the lot formerly owned by
Bushrod Bowery, and being in all respects the same lot as that conveyed
to W. C. Skillman by Nannie B. Hicks and John E. Hicks, by deed dated
October 25, 1922, and recorded in Williamsburg D. B. #9, p. 491.
(2) All that certain piece, parcel or lot of land, together with the
buildings and improvements thereon, situate, lying and being on the West
side of Henry Street in the City of Williamsburg, Virginia, beginning at
a point on said street where the property hereby conveyed adjoins the
property formerly owned by Mittie Thorpe, now owned by Young, thence
from said point South the distance of forty-one feet six inches (41’ 6”)
along said Henry Street to an iron rod driven in the ground; thence West
the distance of two hundred feet (200’) to a fence post; thence North the
distance of thirty-nine (39’) feet to the line of Thorpe (now Young) ;
thence East the distance of two hundred (200’) feet to the point of begin-
ning, the said property being bounded on the North by said Thorpe (or
Young) property; on the East by Henry Street; on the South by the land of
George W. Holmes and on the West by the property of R. D. Wilkins and
Hattie W. Bozarth, being the same property which the said Channing M.
Hall acquired by deed from William F. Rogers and Ola May Rogers, his
wife, dated June 17, 1919, and recorded in Williamsburg Deed Book No. 8,
page 317; and being also the same property reconveyed to said Channing
M. Hall by deed from Frank E. Fletcher and wife and V. M. Geddy,
Trustee, by deed dated April 19, 1923, recorded in Williamsburg D. B.
No. 9, pp. 587-8.
(3) All that unimproved portion of the lot of land situate in the City
of Williamsburg, and bounded as follows: on the North by the upper
portion of lot formerly belonging to Edward Garrett; on the West by the
land belonging to Henry Jamison; on the South by the property of Chris-
topher James; and on the East by the College Landing Road; this lot
fronts said road forty-six (46) feet running back in parallel lines one
hundred and fifty-three (153) feet, more or less. Being the property con-
veyed to R. E. Braxton by deed from B. F. Wolfe, Trustee, recorded in
Deed Book 5, Page 89.
(4) All of that certain lot or parcel of land situate in the City of
Williamsburg, Virginia, fronting on the College Landing Road sixty-two
(62) feet, more or less, and bounded on the East by the said College Land-
ing Road, North by a lane, West by the land now or formerly owned by
Harriet Wilkins, and South by a lot conveyed by B. F. Wolfe, Trustee, to
Ellis Braxton.
(5) All of that certain lot or parcel of land, together with buildings
and improvements thereon, situate in Jamestown District, James City
County, Virginia, and bounded and described as follows: Said lot front-
ing on College Landing Road one hundred (100) feet, and extending West
between parallel lines three hundred (300) feet, and bounded on the South
by the property formerly owned by J. O. Kent, now owned by R. R. Cole,
on the East by the College Landing Road, and on the West and North by
the property formerly owned by Laura V. Rogers and Charles Rogers.
And being the same property conveyed to Andrew Bethune by
Charles L. and Laura V. Rogers by deed dated February 20, 1904, and
recorded in the Clerk’s Office of the Circuit Court for the City of Williams-
burg and County of James City in Deed Book No. 9, Page 247; less a part
of said lot, which was conveyed by Andrew Bethune and Maggie M.
Bethune, his wife, to J. O. Kent by deed dated April 24, 1905, and re-
corded in the Clerk’s Office of the Circuit Court for the City of Williams-
burg and County of James City in Deed Book No. 10, Page 127.
§ 2. Subject to the approval of the Governor in writing first ob-
tained, The College of William and Mary in Virginia is hereby empowered
to negotiate with, and to transfer by deed, in form approved by the Attor-
ney General, to Colonial Williamsburg, Incorporated, the following de-
scribed property:
All that certain lot or parcel of land, together with the buildings and
improvements thereon, situate in the City of Williamsburg, Virginia, and
bounded and described as follows: On the North by Ireland Street, 7714
feet; East by South Henry Street, 112 feet; South by the lot belonging
to Minerva Pickett’s estate; and West by the lot formerly owned by
Bushrod Bowery, and being in all respects the same lot as that conveyed
to W. C. Skillman by Nannie B. Hicks and John E. Hicks, by deed dated
October 25, 1922, and recorded in Williamsburg D. B. #9, p. 491.
This land and buildings thereon may be exchanged for a certain parcel
of land owned by Colonial Williamsburg, Incorporated, as follows:
All that certain lot of land, together with the buildings and improve-
ments thereon, situated in the City of Williamsburg, Virginia, lying on the
West side of Boundary Street, and fronting on said street the distance of
one hundred and forty-two (142) feet, more or less, and running back
between parallel lines to the property of The College of William and Mary
in Virginia, the Northern boundary line of the lot hereby conveyed being
ninety-three (93) feet, more or less, in length, the Southern boundary
thereof being one hundred and fifteen (115) feet, more or less, in length,
and the Eastern and Western boundary lines thereof being each one
hundred and forty-two (142) feet, more or less, in length; being bounded
on the North and West by the property of The College of William and
Mary in Virginia; on the East by Boundary Street; and on the South by
the property of R. C. Nightingale.
§ 3. All moneys received from the exchange of said properties shall
be paid into the State treasury to the credit of The College of William and
Mary in Virginia to be expended by the rector and visitors for the
construction in whole or in part of a new library for The College in Wil-
liamsburg, or for debt reduction, subject to the approval of the Governor.
2. An emergency exists and this act is in force from its passage.
