CHAPTER 482
An Act to amend and reenact § 17-41, as amended, of the Code of
Virginia, relating to when clerk’s office to be kept open. CH 288]

Be it enacted by the General Assembly of Virginia:
1. That § 17-41, as amended, of the Code of Virginia, be amended and
reenacted as follows:
§ 17-41. The clerk’s office of every court shall be kept open on every-
day, except Sunday, the Fourth of July, Thanksgiving Day and Christmas
pay, during convenient hours, for the transaction of business; provided
at:
(1) In cities it may be closed on New Year’s Day, Memorial Day,
Labor Day and Veterans Day, and the judge of the circuit court of any
county may authorize the clerk to close the office on any such day or days;
(2) The judge of any circuit or corporation court may authorize the
clerk to close the office on Saturday at twelve o’clock noon;
(3) In cities having a population of one hundred forty thousand or
more, and in cities having a population of not less than sixty thousand nor
more than ninety thousand, the clerk’s office of any court may be closed
on all days which are made legal holidays under the provisions of § 2-19;
(4) The judge of the circuit court of any county adjoining a city
within or without the territorial limits of the Commonwealth of Virginia
having a population of one hundred forty thousand or more, may authorize
the clerk to close the office on all days which are made legal holidays under
the provisions of § 2-19;
(5) The judge of the circuit court of any county having a population
of more than one thousand per square mile according to the last preceding
United States census, or the judge of any circuit, hustings or corporation
court of any city or county adjoining any such county, or any of them,
may authorize the clerk to close the office on Saturday;
(6) In cities having a population of one hundred thousand or more
and in counties adjoining said cities, and, in cities having a population of
more than eighty thousand but less than one hundred thousand, and, in
cities having a population of more than thirty-eight thousand but less
than forty thousand, the clerk’s office of any court of record may be closed
on Saturday when authorized by the judge of the court;
(6 a) The judge of the circuit court of any county having a popula-
tion of more than twenty-seven thousand, seven hundred but less than
twenty-eight thousand, eight hundred, may authorize the clerk to close the
office on Saturday, provided the governing body of such county approves
such action as evidenced by a resolution adopted by such governing body
and filed in the office of such clerk.
(7) In cities having a population of more than thirty thousand but
less than thirty-five thousand and sixty according to the last decennial
census, the clerk’s office of any court of record may be closed on Saturday,
when authorized by the judge of the court and the governing body of the
city; an
(8) In counties having a population of more than thirty-three thou-
sand five hundred, but less than thirty-four thousand, the clerk may close
the office on Saturday at twelve o’clock, noon.
(9) Except as otherwise provided herein, the clerk’s office of any
court of record in any city or county may be closed on Saturday if so
authorized by the judge of such court and the governing body of such city.
(10) In counties having a population of more than 21,175 and less
than 21,800, the clerk’s office may be closed on Saturday if so authorized
by the judge of the circuit court and governing body of such county.
(11) In counties having a population of more than 6,200 and less
than 6,250 and in counties having a population of more than 19,600 and
less than 19,700, the clerk’s office of the court of record may be closed on
Saturday tf so authorized by the judge of such court and the governing
body of such county.
(12) In counties having a population of more than twenty-one thou-
sand and less than twenty-one thousand one hundred and fifty, the clerk’s
office may be closed on Saturday if so authorized by the judge of the
circuit court and governing body of such county.
(18) In counties having a population of more than twenty-four thou-
sand five hundred and sixty and less than twenty-six thousand five hun-
dred and twenty-two, the clerk’s office may be closed on Saturday if so
authorized by the judge of the circuit court and governing body of such
county.
(14) The clerk’s office of the circuit court of any county having a
population of more than twenty-one thousand five hundred but less than
twenty-two thousand five hundred may be closed on any day which 1s
established as a general holiday for the employees of such county by a
resolution duly adopted by the governing body of such county and approved
by the judge of the circuit court and filed in the office of such clerk.
(15) In any county having a population of more than eighteen thou-
sand, eight hundred but less than eighteen thousand, nine hundred and
which county is adjacent to a city having a hustings court, the clerk’s
office may be closed on Saturday, if so authorized by the judge of the
circuit court and by resolution of the governing body of such county.
Whenever the authorization of the judge is necessary to close a clerk’s
office and a clerk is the clerk of more than one court, or a court has more
than one judge, the authorization of all such judges shall be necessary.
The judge of the circuit court of any county may require the clerk’s
office to be kept open continuously for the transaction of business during
convenient hours on all the days on which it is herein required to be kept
open.
