CHAPTER 427
An Act to amend and reenact §§ 24-131 and 24-870 of the Code of Vir-
ginia, relating to the filing of notices of candidacy in general and
primary elections.

Be it enacted by the General Assembly of Virginia:
1. That §§ 24-131 and 24-370 of the Code of Virginia be amended and
reenacted as follows:
§ 24-131. Notice to clerk of court——Any person who intends to be a
candidate for any office not embraced in the foregoing section, at any
election, shall give notice * not later than ten days after the Tuesday after
the second Monday in July, or if a second primary was held not later than
ten days after the date of the second primary, before the election if it be
a general election held in November, and at least sixty days before a general
election held in June, and at least thirty days before the election if it bea
special election, or within five days after the issuance of any writ of elec-
tion or order calling a special election to be held less than thirty-five days
after the issuance of the writ or order, to the county clerk or clerks of the
county or counties, and to the clerk or clerks of the corporation courts of
the city or cities whose electors vote for such office, which notice shall in
all respects be in the same form as that described by the preceding section
and required to be given to the State Board of Elections.
§ 24-370. Declaration of candidacy.—The name of a candidate shall
not be printed on any official ballot used at a primary unless, in the case
of a candidate for an office filled by election by the qualified voters of the
State at large, or of a congressional district, or for State senator, or for
member of the House of Delegates, or for any county, or magisterial dis-
trict office, or for a city office at least ninety days, * and for any town
office, at least sixty days before the primary, he make and file a written
declaration of candidacy, and has complied with the rules and regulations
of the proper committee of his party.
An emergency exists and this act shall be in force from its passage.
