An Act for the relief of Mr. and Mrs. Luther Smith.

Whereas, one Ear] Smith, a dangerous fugitive from justice, secreted
himself in a barn owned by Mr. and Mrs. Luther Smith of Ferrum, Vir-
ginia, without the knowledge or consent of the owners thereof in an effort
to avoid capture by the authorities; and,
Whereas, in the efficient performance of their duty to capture Earl
Smith, it became necessary for officers of the Department of State Police
to fire tear gas shells into such barn, which shells caused such barn to
burn, destroying such barn and all feed, fixtures and equipment contained
therein; and,
Whereas, it is proper that Mr. and Mrs. Luther Smith be compensated
for the loss which they have sustained; now, therefore,
Be it enacted by the General Assembly of Virginia:
1. §1. There is hereby appropriated from the general fund of the State
treasury the sum of five thousand dollars to be paid to Mr. and Mrs.
Luther Smith upon the execution of a release by them of all claims against
the Commonwealth, such payment to be made by the State Treasurer on
warrant of the Comptroller.
