CHAPTER 41
An Act to amend and reenact § 2, as amended of Chapter 440 of the Acts
of Assembly of 1889-1890, approved March 8, 1890, which provided a
charter for the town of Bedford, the section relating to election of
mayor and council; and to amend said chapter by aaaing sections
numbered 2(a), 2(b), 2(c), 2(d) and 48 to provide for election of a
mayor and vice mayor, to prescribe their powers and duties, to pro-
vide for exercise of such powers and duties in certain cases, to pro-
vide for compensation of the council and mayor, and to authorize the
town to provide certain facilities. CH 124]

Be it enacted by the General Assembly of Virginia:
1. That § 2, as amended, of Chapter 440 of the Acts of Assembly of
1889-1890, approved March 8, 1890 be amended and reenacted and that
said chapter be amended by adding sections numbered 2(a), 2(b), 2(c),
2(d) and 43 as follows: ;
2. * The government of the town shall be vested ina Council which
shall have full power and authority, except as otherwise provided by this
charter, to exercise all of the powers conferred upon the town and to pass
all laws and ordinances relating to its municipal affairs subject to the
Constitution and general laws of the Commonwealth of Virginia.
The council shall consist of seven members whose terms of office,
except as hereinafter provided, shall be for a term of four years. The
present mayor and council shall continue in office and exercise all of the
powers conferred by this charter and the general laws of this Common-
wealth until the expiration of the term for which they were elected or un-
til their successors are duly elected and qualified.
On the second Tuesday in June, nineteen hundred sixty, there shall
be elected by the duly qualified voters of the town at a general municipal
election, seven electors of the town who shall compose the council, who
shall immediately after their qualification cast lots to ascertain which
three shall serve for a term of two years from September one, nineteen
hundred sixty and thereafter until their successors shall have been duly
elected and shall have also qualified; and the remaining four members shall
serve for a term of four years from September one, nineteen hundred sixty
and thereafter until their successors shall have been duly elected and shall
have qualified.
On the second Tuesday in June, nineteen hundred sixty-two, and
every four years thereafter, three councilmen shall be elected who shall
serve for a term of four years from the following September one and there-
pl le their successors shall have been duly elected and shall have
qualified.
On the second Tuesday in June, nineteen hundred sixty-four, and
every four years thereafter, four councilmen shall be elected who shall
serve for a term of four years from the following September one and
thereafter until their successors shall have been duly elected and shall
have qualified. Vacancies in the council shall be filled within thirty days
for the unexpired term, by a majority of the remaining members.
Should the remaining members cast a tie vote, or otherwise be unable
to agree, the clerk of council, after the expiration of such time, shall certify
this fact to the judge of the circuit court of Bedford County who shall
enter an order appointing a qualified person or persons to fill such vacancy
or vacancies.
§ 2 (a). On the first day of September following each regular munici-
pal councilmanic election, or if such day be on Sunday, then on the following
day, the council shall elect one of its members as mayor. He shall be elected
for a term of two years and shall preside at the meetings of the council and
shall perform such other duties and have such other powers as may be
provided for by the council, the town charter or town ordinances, or the
laws of the Commonwealth of Virginia. He shall have a vote and a votce
in the proceedings but no veto. During his absence or disability, his duties
shall be performed by the vice mayor.
§ 2 (b). On the first day of September following each regular munict-
pal councilmanic election, or if such day be on a Sunday, then on the day
following, the council shall elect one of its members as vice mayor. He shall
be elected for a term of two years, and when the mayor is absent, or for
any reason cannot act or perform his duties as mayor, the vice mayor shall
be invested with all of the powers conferred upon the mayor.
§ 2 (c). In the absence or in the case of disability of both the mayor
and vice mayor, one of the other councilmen elected by a majority vote of
the council, shall have all of the powers heretofore conferred upon the
mayer | and vice mayor.
2 (d). Commencing September one, nineteen hundred sixty, the mem-
bers of the council shall receive such compensation as the council may pre-
scribe not to exceed the sum of three hundred dollars per annum. The
mayor, in addition to his compensation as a member of the council, shall
receive such additional sum as the council may prescribe, not to exceed 81x
hundred dollars per annum.
§ 48. The Council, in addition to its other powers, shall have the
power on behalf of the town to provide and operate public libraries,
armories, cemeteries and markets or contract with others for supplying
such facilities.
