An Act for the relief of Lewis Earl Hawkins.

Whereas, Lewis Earl Hawkins of Culpeper County on October 16, 1958
was the owner of a herd of cattle which included one certain Angus cow
having a market value of two hundred and twenty-five dollars; and
Whereas, the State Veterinarian, by and through his agents and
employees, did order said herd of cattle isolated and did cause to be
conducted upon said cow, among others, certain tests for Bang’s disease,
which tests were performed by said agents and employees who then and
there used and employed for the purpose, among other things, a certain
stanchion, or stall, having doors, or gates, constructed of wood and steel;

Whereas, said agents and employees, in attempting to prevent the
escape of a heifer, did close the said doors or gates, of said stanchion, or
stall, upon the right hind leg of said cow, thereby severing said leg
approximately six inches above the hoof; and
Whereas, as the direct result of said act, the said cow did die; and
Whereas, the carcass of said cow could not be sold or consumed because
said tests had not been completed ; and
Whereas, the said herd subsequently was found to be free of Bang’s
disease; and
Whereas, the said Lewis Earl Hawkins thereby has suffered a loss of
one hundred and fifteen dollars; now, therefore,
Be it enacted by the General Assembly of Virginia:
1. The Department of Agriculture is authorized to pay the sum of one
hundred and fifteen dollars to Lewis Earl Hawkins and the said payment
may be delivered to the said Lewis Earl Hawkins upon his executing a
proper release of all claims against the Commonwealth by reason of the
foregoing.
An emergency exists and this act is in force from its passage.
