CHAPTER 389

An Act to amend the Code of Virginia by adding a section numbered
19-187.1, to provide for preliminary examinations of persons arrested
upon a warrant charging a felony and to provide for waiver thereof.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia be amended by adding a section numbered
19-137.1 as follows:

§ 19-137.1. No person who is arrested on a charge of felony shall
be denied a preliminary hearing upon the question of whether there is
reasonable ground to believe that he committed the offense and no in-
dictment shall be returned in a court of record against any such person
prior to such hearing unless such hearing is waived in writing.

An emergency exists and this act in in force from its passage.
