An Act to add a new section to the Code of Virginia known as 8-477.1,
relating to the posting of bond by a garnishee or other person indebted
to a person against whom a judgment has been obtained pending an
appeal to the Supreme Court of Appeals.
Be it enacted by the General Assembly of Virginia:
1. That a new section be added to the Code of Virginia and be known
as § 8-477.1 as follows:
§ 8-477.1. In any case pending an appeal or other action in the
Supreme Court of Appeals of Virginia from a judgment secured in a trial
court, a garnishee or other person indebted to or who is claimed to be in-
debted to a person appealing to, or filing a petition for writ of error to, or
who may appeal or file such petition, to the Supreme Court of Appeals of
Virginia, may post a bond in the trial court where such judgment was
obtained with surety approved by the Clerk of such trial court and fixed
by the trial court in an amount sufficient to pay the principal amount
owed or claimed to be owed by the said garnishee or other person indebted
to such party appealing or seeking a writ of error, together with interest
and conditioned to pay any final judgment against such garnishee or other
person for such debt or claimed debt, and upon posting of such bond all
proceedings against such garnishee or other person shall be stayed in the
trial court pending final action by the Supreme Court of Appeals on such
appeal or writ of error.
