CHAPTER 211
An Act to amend the Code of Virginia by adding thereto a section num-
bered 15-707.1, authorizing the governing body of any county, city or
town to provide for adequate drainage of any and all areas within
such county, city or town, and for the acquisition by purchase, lease,
condemnation or otherwise of certain property needed for such
purpose.

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding thereto a section
numbered 15-707.1 as follows:
§ 15-707.1. The governing body of any county, city or town shal]
have power to provide for adequate drainage of any and all areas in the
county, city or town, and to effectuate such power may install and main-
tain drainage systems, and acquire, by gift, purchase, lease, condemnation
or otherwise, lands, buildings, structures or any interest therein and may
appropriate money therefor. The power of eminent domain is vested in any
such governing body to the extent necessary to effect such acquisition.
The provisions of this section as to the power of condemnation shall
be subject to the provisions of § 25-233 of the Code of Virginia.
It is the intention of the General Assembly that this act shall be
liberally construed to effectuate the purposes set out herein, and if any
clause, sentence, paragraph or section of this act shall ever be declared
unconstitutional, it shall be deemed severable, and the remainder of this act
shall continue in full force and effect.
An emergency exists and this act is in force from its passage.
