An Act to amend and reenact § 61-182 of the Code of Virginia, relating
to duties of samplers and proprietors of tobacco warehouses, 1877
Approved March 7, 1960
Be it enacted by the General Assembly of Virginia:
1. That § 61-132 of the Code of Virginia be amended and reenacted as
follows:
§ 61-132. The samplers of each warehouse shall account for and
pay to the proprietors thereof, on the tenth day of April, the tenth day of
July, the tenth day of October, and the tenth day of January, in each year,
all money received, or which ought to be received, by them, to the use of
the proprietors. And * each proprietor of * a warehouse selling loose leaf
tobacco at auction shall keep, free of charge to the planter and owner of
any such loose leaf tobacco, * valid insurance * sufficient to cover * any
loss * caused by any of the perils insured against in the standard policy
of fire insurance and the Extended Coverage Endorsement as now or here-
after approved by the State Corporation Commission for use in Virginia
to such tobacco while in the custody of the proprietor for auction unttl
such tobacco has been actually auctioned off and removed from the sales
floor area by the owner thereof or until siz o’clock post meridian of the
calendar day following the auction of such tobacco, whichever sooner
occurs; and, for * failure so to do, * the proprietor shall be liable to the
owner * of such tobacco for any * loss * sustained by reason of any partial
or total destruction of * such tobacco by * any of such causes; provided,
however, that if the owner or buyer of such tobacco has specific or general
insurance which, in the absence of the insurance required by the provt-
sions of this section, does or would reimburse such owner or buyer for his
loss, then and in that event there shall be no contribution from the pro-
prietor or his insurance carrier with respect to such loss.
