An Act to amend and reenact 8§ 23-98 and 28-94 of the Code of Virginia,
relating to the board of visitors of the Virginia Military Institute.

Be it enacted by the General Assembly of Virginia:
1. That §§ 23-93 and 23-94 of the Code of Virginia be amended and
reenacted as follows:
§ 23-93. The board of visitors is to consist of * fifteen visitors, eleven
to be appointed by the Governor from the State at large, two to be ap-
pointed by the Governor from nonresident alumni, and the Adjutant Gen-
eral and the Superintendent of Public Instruction, ex officio. The ap-
pointive visitors in office on * the effective date of this act are continued
in office until the end of their respective terms. * The Superintendent and
Adjutant General shall remain eligible for appointment as ex officio mem-
bers 80 long as they continue in office as Superintendent or Adjutant
eneral.
All appointments for full terms, as well as to fill vacancies, shal
be made by the Governor subject to confirmation by the Senate.
§ 23-94. (a) The Governor may appoint visitors from a list of
qualified persons submitted to him by the alumni association of the Vir-
ginia Military Institute, on or before the first day of April of any year in
which the terms of any visitors will expire.
(b) Whenever a vacancy occurs, otherwise than by expiration of term,
the Governor shall certify this fact to the association and nominations
may be submitted of qualified persons and the Governor may fill the
vacancy, if his discretion so dictates, from among the eligible nominees of
the association.

(e) At * least ten of the appointive visitors shall be alumni of the
Institute.
2. An emergency exists and this act is in force from its passage.
