An Act to amend and reenact §§ 23-14, as amended, 23-39, 28-40, 28-41,
23-42, 23-44, 28-45, 28-47, 28-49, and 28-49.1 and repeal § 28-48 of
the Code of Virginia, relating to the College of William and Mary in
Virginia.

Be it enacted by the General Assembly of Virginia:
1. That §§ 23-14, as amended, 23-39, 23-40, 23-41, 23-42, 23-44, 28-45,
mare ; seals and 23-49.1 of the Code of Virginia be amended and reenacted
as follows:
§ 23-14. The Colleges of William and Mary * at Williamsburg; the
Medical College of Virginia, at Richmond; the board of visitors of the
Virginia State School, at Newport News; the State Teachers’ College, at
Farmville; the Mary Washington College of the University of Virginia, at
Fredericksburg; the Madison College, at Harrisonburg; the Radford Col-
lege, Woman’s Division, Virginia Polytechnic Institute, at Radford; the
rector and visitors of the University of Virginia, at Charlottesville; the
Virginia Military Institute, at Lexington; the Virginia Polytechnic Insti-
tute, at Blacksburg; the Virginia School for the Blind, at Charlottesville;
the Virginia School for the Deaf and Blind, at Staunton; the Virginia
State College, at Petersburg; and the Woodrow Wilson Rehabilitation
Center, at Fishersville, are hereby classified as educational institutions,
and are declared to be public bodies and constituted as governmental
instrumentalities for the dissemination of education. The powers of every
such institution derived directly or indirectly from this chapter shall be
vested in and exercised by a majority of the members of its board, and a
majority of such board shall be a quorum for the transaction of any busi-
ness authorized by this chapter.
23-39. The board of visitors of The Colleges of William and Mary
shall be a corporation under the style of “The Colleges of William and
ary ”
§ 23-40. All the real estate and personal property * now existing
and standing in the name of the corporate body designated * ‘“The College
of William and Mary in Virginia’ shall be transferred to and be known
and taken as standing in the name, and to be under the control of the
corporate body designated “The Colleges of William and Mary *.” Such
shine _ and personal property shall be the property of the Common-
wealth.
§ 23-41. (a) The board of visitors is to consist of * fourteen mem-
bers to be appointed by the Governor from the State at large, and the
Superintendent of Public Instruction ex officio. The visitors * of The
College of William and Mary in Virginia in office on March seventh, nine-
teen hundred sixty, are hereby declared to be visitors of The Colleges of
William and Mary, and are continued in office until their respective terms
would have otherwise expired.
(b) * On or before March first, nineteen hundred and * sizty, and
biennially thereafter, the Governor shall appoint, for the term of four
years, the successors of the * visitors whose terms are about to expire.
Within thirty days of the effective date of this act, the Governor shall
appoint two additional visitors for terms to expire March sixth, nineteen
hundred sixty-two, and two additional visitors for terms to expire March
sixth, nineteen hundred sixty-four. Thereafter, all visitors shall be ap-
pointed for terms of four years. The Governor shall appoint for a term
of four years the Superintendent of Public Instruction as an ex officio
visitor, such membership to be vacated, however, with the termination of
his tenure as Superintendent. |
(c) All vacancies, whether occasioned by failure to make an appoint-
ment within the sixty days preceding any regular expiration as required,
or otherwise, are to be filled by the Governor for the unexpired term.
(d) All appointments are subject to confirmation by the General
Assembly if in session when such appointments are made, and if not in
session, then at its next succeeding session. Visitors shall continue to dis-
charge their duties after their terms have expired until their successors
have been appointed and have qualified.
§ 23-42. (a) The Governor may appoint visitors from a list of
qualified persons submitted to him, before or after induction into office, by

before the first day of December of any year next preceding a year or In
which the terms of any visitors will expire. a
(b) Whenever a vacancy occurs, otherwise than by expiration of
term, the Governor shall certify this fact to the associations and noming.

vacancy, if his discretion so dictates, from among the eligible nominees 0
the associations, whether or not alumni or alumnae.
(c) Every list shall contain at least three names for each vacancy to
be filled. .
(d) The Governor is not to be limited in his appointments to the
persons so nominated.
§ 23-44. The board of visitors shall be vested with all the rights
and powers conferred by the provisions of this chapter and by the ancient
royal charter of the College of William and Mary in Virginia, In so far as
the same are not inconsistent with the provisions of this chapter and the
general laws of the State.
The board shall control and expend the funds of the Colleges and any
appropriation hereafter provided, and shall make all needful rules and
regulations concerning the Colleges, * and generally direct the affairs of
the Colleges.
§ 23-45. The board of visitors may fix in their discretion, the rates
charged the students of the Colleges for * tuition, fees and other necessary
charges.
23-47. * One or more of the Colleges shall maintain in connection
with * their collegiate courses * a system of * instruction and training for
the purpose of educating and training white teachers for the public free
schools of the State.
§ 23-49. * The Colleges shall admit properly prepared women to
their collegiate * courses, and upon graduation shall grant them degrees
upon the same terms as those upon which like degrees are granted to men.
§ 23-49.1. (a) The College of William and Mary in Virginia, now
located in Williamsburg, the Norfolk Division of the College *, and the
Richmond Professional Institute, and the divisions at Newport News and
Petersburg, respectively, * are hereby established as * Colleges of The
Colleges of William and Mary, * and are integral parts thereof. Such *
Colleges shall be subject to the supervision, management and control of
the board of visitors of The Colleges of William and Mary. Such colleges
shall be separate from each other and each college shall report directly to
the Board of Visitors through the Chancellor.
(b) All property, property rights, duties, contracts and agreements
of * the several colleges are vested in the board of visitors of the Colleges
of William and Mary. * The chief executive officer of The Colleges of
William and Mary shall be designated as Chancellor of the Colleges; the
chief executive officers of the colleges granting baccalaureate or higher
degrees shall be designated as presidents; the chief executive officers of
such two-year colleges as may be authorized by the General Assembly and
made by it integral parts of The Colleges of William and Mary shall be
designated as directors. The board of visitors of The Colleges of William
and Mary is charged with the care and preservation of all property belong-
ing to the * several colleges. With respect to the * several colleges, the
board of visitors shall have the same powers as to granting degrees, as to
fixing tuitions, fees, and other charges, as to the appointment and removal
of administrative officers, professors, agents and * employees, and the
making of rules and regulations, as are now vested in them with respect
to the College of William and Mary in Virginia; provided, that no degree

shall be conferred for completion of the course of instruction offered at the
divisions at Newport News and Petersburg. *
(c) Appropriations directly and indirectly from the State to the
several colleges * shall be expended as directed by the board of visitors of
The Colleges of William and Mary ”*. _
(d) The Board of Visitors of The Colleges of William and Mary 1s
authorized and directed to prepare the by-laws for The Colleges of Wilham
and Mary, to define the functions of the several colleges, and to specify the
responsibilities of the Chancellor, the chief executive officers, all professors,
teachers and agents of the several colleges, as the board may deem
necessary. _
(e) The Board of Visitors of The Colleges of William and Mary shall
appoint a Chancellor of the Colleges of William and Mary, the presidents
and the chief executive officers, all professors, teachers and agents of the
several colleges and fix their salaries. The Chancellor shall be appointed
and take office on or before July one, nineteen hundred sixty-one.
(f) The board of visitors is hereby empowered to choose distinctive
and appropriate titles for all constituent colleges except for the college at
Walhamsburg which shall be known as The College of Wiliam and Mary in
irginia.
2. § 238-48 of the Code of Virginia is repealed.
3. Anemergency exists and this act is in force from its passage.
