CHAPTER 64
An Act to amend Chapter 57 of the Acts of Assembly of 1940, approved
February 20, 1940, which provided a new charter for the town of Wise,
by adding new sections numbered 5-A and 5-B, relating to a special
justice and a police justice; and to amend and reenact §§ 8 and 22
thereof, relating to salaries of certain officers and municipal securitves.

Be it enacted by the General Assembly of Virginia:
1. That Chapter 57 of the Acts of Assembly of 1940, approved Febru-
ary 20, 1940, be amended by adding new sections numbered 5-A and 5-B,
and that §§ 8 and 22 thereof be amended and reenacted, the new and
amended sections being as follows: .
§ 5-A. The council may also appoint a special justice for the issuance
of warrants of arrest; such justice shall also have power, if the council
8o prescribes, to grant or deny bail in proper cases and when bail is denied
to remand persons to jail as provided by law. The term of office of such
special justice shall not be for a term beyond that of the council by which
he is appointed. His compensation shall be that provided by general law.
§ 5-B. The council may at any time it deems the same expedient
appoint a police justice for the town who shall give such bond as the coun-
cul requires, shall serve during the pleasure of council and shall receive
such compensation as the council prescribes. Nothing in this chapter shall
prevent a member of council from serving as police justice.
In the event of the appointment of such police justice, he shall have,
during such time as he serves, and to the exclusion of the mayor, the same
power and jurisdiction as are hereinafter conferred upon and vested in the
mayor but only in the trial and disposition of police matters and shall exer-
cise the same in like manner as they are above authorized and directed to
be exercised by the mayor.
. The salary of the mayor of the town, as now constituted or
hereafter elected, if any be allowed by the council, shall be fixed by the
council, but in no event to exceed * twenty-four hundred dollars per an-
num. The four (4) councilmen, as now constituted or hereafter elected,
may receive a salary to be fixed by the said council, not to exceed fifty
dollars per annum for each councilman. The salary of the mayor and
councilmen, if any, when fixed shall so continue until changed by the
council, and shall be payable out of the treasury of the town in monthly
installments. The council shall fix the salary of its clerk, and such other
officers, agents, and employees as it may deem appropriate; provided, no
salary shall be fixed for a period to exceed one year.
§ 22. Bonds, notes and other evidences of indebtedness may be is-
sued by the town for such purposes and in such manner as are prescribed
by Chapter One Hundred and Twenty-two of the Code of Virginia, the Con-
stitution, or any other general statute on the subject of bond issues by
towns or the issue of other municipal securities. *
2. An emergency exists and this act is in force from its passage.
