CHAPTER 637
AN ACT to amend and reenact § 20-63, as amended, of the Code of Vir-
ginia, relating to payments to dependents of persons convicted of
desertion or nonsupport.

Be it enacted by the General Assembly of Virginia:
1. That § 20-63, as amended, of the Code of Virginia be amended and
reenacted as follows:
§ 20-63. (a) It shall be the duty of the governing body of the
county or city within the boundaries of which any work is performed
under the provisions of this chapter to allow and order payment at the end
of each calendar month, out of the current funds of the county or city,
to the court which originally sentenced the prisoner for the support of his
wife or child or children, a sum not less than five nor more than fifteen dol-
lars for each week in the discretion of the court during any part of which
any work is so performed by such prisoner.
(b) If the prisoner be sentenced to the State convict road force the
sum or sums provided for in paragraph (a) shall be paid by the State
* treasury out of the funds * appropriated for the payment of criminal
costs, and such payments shall begin when such prisoner is admitted to
the State convict road force; provided, however, if the person or persons
on whose behalf the sums specified in this paragraph are to be paid has
been, or should thereafter be, found eligible for public assistance under
any provision of Title 63 of this Code, the sums specified in this paragraph
or the amount required to reimburse the State and the county or city for
public assistance granted such person or persons, whichever is less, shall
be paid to the Department of Welfare and Institutions for reimbursement
in accordance with rules and regulations of the State Board of Welfare
and Institutions. Notwithstanding any other provision of law to the con-
trary, in determining the amount of assistance to which any person pro-
vided for in this paragraph shall be entitled, there shall be excluded from
consideration any sums payable under this paragraph.
