CHAPTER 59
An Act to authorize the Governor to grant, release and quit claim to
George Cole Scott and Thomas S. Martin, Jr., and Catherine R. Mar-
tin, his wife, the owners of tracts of land totalling 50 acres, more or
less, in the city of Richmond, all those rights and things reserved to the
Commonwealth in a certain deed made by it to George W. Jordan and
others insofar as such reservations affect such land. rH 262)

Whereas, pursuant to Chapter 349 of the Acts of the General As-
sembly of 1859-60, the Commonwealth of Virginia, by John Letcher, Gov-
ernor, by its deed dated February 11, 1863, and recorded January 31, 1867,
in the Clerk’s Office of the Circuit Court of the County of Henrico,
Virginia, granted and conveyed to George W. Jordan and others all the
right, title and interest of the Commonwealth in and to a tract of land
in the County of Henrico and on the James River and Kanawha Canal,
known as the Westham Magazine tract of land, containing seventeen and
one-eighth acres, more or less; reserving to the Commonwealth, however,
as required by said Chapter 349, all the granite and other stone in and on
the said land, with full and unrestricted right to the Commonwealth of
uarrying for and removing the same, and of ingress and egress for that
object; and
Whereas, four and six-tenths acres of the Westham Magazine tract,
which tract has since been incorporated into the City of Richmond, Vir-
ginia, was conveyed to Julia Louise Reynolds by deed from Edward F.
Willis and Nancy Clark Willis, his wife, dated December 17, 1946, and
recorded December 18, 1946, in the Clerk’s Office of the Chancery Court
of the City of Richmond, Virginia; and
Whereas, Chapter 63 of the Acts of the General Assembly, Extra
Session, 1947, authorized the Governor, in his discretion, and for such
consideration as he deemed proper and fair, to execute and deliver a deed
granting, releasing and quit claiming unto Julia Louise Reynolds all the
right, title and interest of the Commonwealth in and to all the granite and
other stone in and on said four and six-tenths acres of land and quarrying
and other rights reserved with respect thereto, all as set out in the deed
dated February 11, 1863; and
_ Whereas, the remainder of the Westham Magazine tract is now owned
in part by George Cole Scott, such portion having been conveyed to him
by deed from Hildreth Dunn Scott Davis, dated May 28, 1953, and record-
ed June 4, 1953, in the Clerk’s Office of the Chancery Court of the City
of Richmond, Virginia, and the balance is owned by Thomas S. Martin, Jr.
and Catherine R. Martin, his wife, such balance having been conveyed to
them as tenants by the entireties with the right of survivorship as at
common law by deed from Stewart C. Wilson and Gertrude Wagoner
Wilson, his wife, dated December 18, 1951, and recorded December 15,
1951, in the Clerk’s Office of the Chancery Court of the City of Richmond,
Virginia, the total area so owned by George Cole Scott, Thomas S. Martin,
Jr., and Catherine R. Martin being 50 acres, more or less; and —
Whereas, the title of George Cole Scott in and to that portion of the
Westham Magazine tract owned by him, and the title of Thomas S. Mar-
tin, Jr., and Catherine R. Martin in and to that portion of the Westham
Magazine tract owned by them are still subject to the cloud of the above
mentioned reservations in favor of the Commonwealth; now, therefore,
Be it enacted by the General Assembly of Virginia: .
1. § 1. That the Governor be and he is hereby authorized, in his
discretion, and for such consideration as he deems proper and fair, to
execute and deliver a deed granting, releasing and quit claiming unto
George Cole Scott all the right, title and interest of the Commonwealth in
and to all the granite and other stone in and on that portion of the West-
ham Magazine tract owned by the said George Cole Scott, and the quarry-
ing and other rights with respect thereto, all as set out in the deed dated
February 11, 1863; and unto Thomas S. Martin, Jr., and Catherine R.
Martin, his wife, all the right, title and interest of the Commonwealth in
and to all the granite and other stone in and on that portion of the West-
ham Magazine tract owned by the said Thomas S. Martin, Jr., and Cath-
erine R. Martin, and the quarrying and other rights with respect thereto,
all as set out in the deed dated February 11, 1863.
2. An emergency exists and this act is in force from its passage.
