CHAPTER 55
An Act to amend and reenact § 11.01 of Chapter 9 of the Acts of Assembly
of 1952, Extra Session, approved December 16, 1952, being the charter
of the City of Hampton, the section relating to school board and
superintendent of schools; and to amend such chapter by adding a
section numbered 18.11, relating to associate civil and police justice.
Be it enacted by the General Assembly of Virginia:
1. That § 11.01 of Chapter 9 of the Acts of Assembly of 1952, Extra
Session, approved December 16, 1952, be amended and reenacted, and
ue such chapter be amended by adding a section numbered 13.11, as
ollows:
§ 11.01. School Board and Superintendent of Schools.—The depart-
ment of education shall consist of the city school board, the division
superintendent of schools, and the officers and employees thereof. Except
as otherwise provided in this charter, the city school board and the
division superintendent of schools shall exercise all the powers conferred
and perform all the duties imposed upon them by general law.
The school board of the City of Hampton shall be composed of seven
trustees, who shall be chosen by the council. The school trustees * in office
when this act takes effect * shall continue to serve until the expiration of
the term for which they were appointed. * Any vacancy occurring by
reason of death, resignation or removal in the school board shall be filled
by the council for the unexpired term. Any vacancy occurring by reason
of the expiration of any term of appointment shall be filled by the council
for a term not to exceed five years. No school trustee shall be reappointed
to succeed himself more than once, nor shall any person serve more than
ten years on the school board.
The division superintendent of schools shall be appointed and serve
for a term of office as prescribed by general law. *
§ 18.11. Associate Civil and Police Justice.—The council may ap-
point an associate judge of the civil and police court, who shall hold office
for a term concurrent with that of the judge of the civil and police court.
The associate judge shall serve at such time or times and perform such
duties as may be designated by the council, and while so serving shall
be subject to the same obligations, perform the same duties and have the
same power and authority as the judge. The judge of the civil and police
court may, unless otherwise provided by ordinance, assign the work of the
court between himself and the associate and substitute judges. The as-
sociate judge may serve concurrently with the judge of the court or with
any substitute, or alone. The compensation of the associate judge shall
be established in accordance with § 138.04.
2. An emergency exists and this act is in force from its passage.
