An Act to amend and reenact § 29-145.1, as amended, of the Code of
Virginia, relating to killing deer damaging fruit trees and OE a7

Be it enacted by the General Assembly of Virginia:
1. That § 29-145.1, as amended, of the Code of Virginia be amended
and reenacted as follows:
§ 29-145.1. Whenever it is found that deer are damaging fruit trees
or crops in the State, the owner or lessee of the lands on which such
damage is done shall immediately report such fact to the local game
warden for investigation. If after investigation the game warden finds that
deer have so injured the fruit trees or crops of such owner or lessee as
to cause substantial damage, he shall authorize the owner or lessee to
kill such deer when they are found upon his premises and in the act of
further injuring such trees or crops.
The carcass of every deer so killed shall be delivered by the owner
or lessee to the game warden of the county, who shall deliver it to such
charitable institution or hospital as designated by the Commission of
Game and Inland Fisheries; provided, however, that in the counties of
Shenandoah, Isle of Wight, Nansemond, Southampton and Rappahannock
any deer after the first so killed in any year shall, upon request, be
awarded by the game warden to the owner or lessee, who shall give such
person a certificate to that effect on forms furnished by the Commission
of Game and Inland Fisheries. Any person awarded a deer under this
section may make use thereof as if the same had been killed by him dur-
ing the season therefor.
