CHAPTER 628
An Act to create and constitute a political subdivision known as Shenan-
doah Valley Joint Airport Commission with authority to exercise the
power of eminent domain.

Be it enacted by the General Assembly of Virginia:
1. § 1. “Commission” as used herein, shall mean Shenandoah Valley
Joint Airport Commission established under the provisions of Article 2,
Chapter 3, Title 5 of the Code of Virginia, by the joint action of the
pounties of Augusta and Rockingham and the cities of Harrisonburg and
unton.
§ 2. The Commission is hereby created and constituted a political
subdivision of the counties of Augusta and Rockingham and the cities of
darrisonburg and Staunton. The exercise of the powers and duties con-
erred upon the Commission by the said counties and cities by their
"espective ordinances with respect to the construction, operation and main-
enance of an airport, and the acquisition of land necessary for such air-
20rt, shall be deemed and held to be for the public use and in the per-
formance of an essential governmental function.
3.3. The Commission, in addition to the powers and duties delegated
Lo it by the participating counties and cities, shall have the following
powers:
To acquire under the power of eminent domain, or by purchase, lease,
or otherwise, all the property of any person, partnership, association or
corporation deemed necessary for the establishment, use, operation and
maintenance of an airport.
§ 4. Proceedings for condemnation hereunder shall be instituted and
conducted in the name of the Commission, and the procedure shall be
in the manner and under the restrictions prescribed by the general
statutes of this State relative to the condemnation of lands and the rights
of all persons, partnerships, associations or corporations affected shall be
subject to the general laws of this State, in so far as the same may be
applicable under the general purposes of this act.
2. An emergency exists and this act is in force from its passage.
