CHAPTER 305
An Act to amend and reenact §§ 58-154 and 58-220 of the Code of Vir-
ginia, relating to exemption from inheritance and gift tazes, respec-
tively, so as to exempt from such taxation certain non-profit organiza-
tions operated to restore, maintain and beautify historical and other
gardens.

Be it enacted by the General Assembly of Virginia:
1. That §§ 58-154 and 58-220 of the Code of Virginia be amended and
re-enacted as follows:
§ 58-154. There shall be exempt from any and all taxation under
the provisions of this chapter so much of such property as shall so pass
to or for the use of:
(1) The United States, any state, territory or any political subdivision
thereof, or the District of Columbia, for exclusively public purposes ;
Any corporation or trust or community chest, fund or foundation,
organized and operated exclusively for religious, charitable, scientific,
literary or educational purposes or for the prevention of cruelty to chil-
dren or animals, no part of the net earnings of which inures to the benefit
of any private shareholder or individual;
(3) The special fund for vocational rehabilitation authorized by
section seven of the Federal Vocational Rehabilitation Act;
(4) Posts or organizations of war veterans or auxiliary units or
societies of any such posts or organizations, if such posts, organizations,
units or societies are organized in the United States or any of its posses-
sions and if no part of their net earnings inures to the benefit of any private
shareholder or individual; *
(5) A fraternal society, order or association, operating under the
lodge system; or
(6) A corporation or association organized and operated exclusively
for the restoration and maintenance of historic gardens and the general
promotion of beautiful gardens, no part of the net earnings of which inures
to the benefit of any private shareholder or individual.
§ 58-220. There shall be exempt from any and all taxation under
the Provisions of this chapter such property as shall so pass to or for the
use of :
(1) The United States, any state, territory or any political subdi-
vision thereof, or the District of Columbia, for exclusively public purposes;
(2) Any corporation or trust or community chest, fund or foundation,
organized and operated exclusively for religious, charitable, scientific,
literary or educational purposes or for the prevention of cruelty to chil-
dren or animals, no part of the net earnings of which inures to the benefit
of any private shareholder or individual;
(3) The special fund for vocational rehabilitation authorized by sec-
tion seven of the Federal Vocational Rehabilitation Act;
(4) Posts or organizations of war veterans or auxiliary units or
societies of any such posts or organizations, if such posts, organizations,
units or societies are organized in the United States or any of its posses-
sions and if no part of their net earnings inures to the benefit of any private
shareholder or individual; *
(5) A fraternal society, order or association, operating under the
