CHAPTER 284
An Act to amend and reenact § 8-600 and §§ 8-602 and 8-608, as amended,
of the Code of Virginia, relating, respectively, to certain producers
of eggs, sale of inedible or incubated eggs, and determining and mark-
ing grade of eggs and to amend the Code of Virginia by adding a
section numbered 8-608.1 to require that certain purchasers of eggs
be furnished with an invoice.

Be it enacted by the General Assembly of Virginia:
1. That § 3-600 and §§ 8-602 and 3-603, as amended, of the Code of
Virginia be amended and reenacted and that the Code of Virginia be
amended by adding a section numbered 3-603.1 as follows:
§ 3-600. Producers selling * eggs produced by their own hens, or
eggs purchased from other producers not to exceed sixty (60) dozen a
week from such other producers, direct to household users, restaurants,
hotels, retail stores, bakeries, or other institutions purchasing eggs for
serving to guests, patrons, employees or inmates are exempt from this
ie puoviied all eggs are of edible quality and of the quality as repre-
sented.
§ 8-602. The sale or offering for sale of inedible eggs as defined in
the official grades adopted by the Commissioner of Agriculture is pro-
hibited except that incubated eggs may be sold for commercial purposes
other than for human consumption provided such incubated eggs are
marked, packaged, and disposed of * in a manner approved by the
Commissioner.
§ 3-603. This article shall be enforced by the Commissioner of Agri-
culture or his duly authorized agents and all eggs offered for sale except
e exempted in §§ 8-600 and 3-601 of the Code of Virginia shall be
ked according to the official grades and sizes adopted by the Com-
sioner with the approval of the Board of Agriculture and Immigration
shall conform to the standards established for the grade and size as
led or marked * “ungraded”. Official determination of the quality of
ggs outlined in this article shall be by candling or breaking out.
§ 3-603.1. Any person, firm or corporation selling or delivering eggs
produced by hens owned by such person, firm or corporation to res-
‘ants, hotels, retail stores, bakeries or other institution purchasing
3 for serving to guests, patrons, employees or inmates shall furnish
purchaser with an invoice showing the name and address of the seller
the quantity, grade and size of such eggs. If the eggs are ungraded,
. fact shall appear on the invoice. A copy of such invoice shall be
ined by the seller and purchaser for not less than thirty days.
