An Act to amend Chapter 157 of the Acts of Assembly of 1908, approved
March 10, 1908, which provided a new charter for the city of Ports-
mouth, by adding thereto a section numbered 28-e, so as to provide
the power of council with respect to terms of office on the Planning
Commission and to provide the term of ex officio members. rat 2671

Be it enacted by the General Assembly of Virginia:
1. That Chapter 157 of the Acts of Assembly of 1908, approved March
10, 1908, be amended by adding thereto a section numbered 23-e, as
ollows:
§ 23-e. The members of the Planning Commission created under
the provisions of general law shall serve for such term as may be ordained
by the council within the limits of general law, except that the council
may by ordinance prescribe shorter terms, for any member or members
of the Planning Commission thereafter appointed, for the purpose of stag-
gering the terms of office so that the terms of some member or members
shall commence each year, but subsequent terms served by such member
or members or their successors in office shall be of the same length as the
terms served by other members of the Planning Commission.
Each ex officio member of the Planning Commission shall serve on
the Planning Commission during the tenure of his official position, except
that his term in no event shall exceed in length the regular term of mem-
bership on the Commission of the appointed members.
2. An emergency exists and this act is in force from its passage.
