An Act to amend and reenact § 8-628.1 of the Code of Virginia, and to
repeal § 8-628 of the Code of Virginia, both relating to surviving
rights of action.

Be it enacted by the General Assembly of Virginia:
bs That § 8-628.1 of the Code of Virginia be amended and reenacted as
follows:
§ 8-628.1. No cause of action for injuries to person or property
‘shall be lost because of the death of the person liable for the injury. No
cause of action for injuries to person or property shall be lost because of
the death of the person in whose favor the cause of action existed, provided,
however, in such action no recovery can be had for mental anguish, pain
or suffering. * No such action for personal injuries, except an action
brought by any person under disability at the time of the inquiry may
be brought more than * two years after the injuries occurred. Nothing
contained in this section shall be construed to extend the time within which
an action for any other tort shall be brought, nor to give the right to
assign a claim fora tort not otherwise assignable. The amendment ex-
tending the period within which an action may be brought under this
section to two years shall not apply to any cause of action arising prior
to July one, nineteen hundred fifty-four.
2. § 8-628 of the Code of Virginia is repealed.
