An Act to amend and reenact §§ 8-759, 8-761, and 8-778 of the Code of
Virginia, relating to recovery of debts due the State. rH 844]

Be it enacted by the General Assembly of Virginia:
1. That §§ 8-759, 8-761, and 8-773 of the Code of Virginia be amended
and reenacted as follows:
§ 8-759. The proceeding may be in the circuit court of the city of
Richmond. *
§ 8-761. Any such * action may be instituted against any person
indebted or liable to the Commonwealth in any way whatever, and against
his sureties, and against his and their personal representatives. And it
may be made when the debt or liability is created or secured by a bond
or other instrument, whether the same be payable to the Commonwealth
or to any person acting in a public character on behalf of the Common-
wealth, or be for the payment of money or the performance of other duties.
tA judgment on any such motion shall be in the name of the Common-
wealth.
§ 8-773. Against the personal representatives of such of the obligors
as may have died before any such bond has the force of a judgment against
the survivors, judgment may be obtained by action * at law.

Be it enacted by the General Assembly of Virginia:
oa That § 8-4.1 of the Code of Virginia be amended and reenacted as
ollows:
| § 8-4.1. In addition to the exemptions made by §§ 30-4, 30-6, 30-7
and 30-8, the following persons shall be privileged from arrest under civil
process, to-wit:
(1) The President of the United States and the Governor of this
State at all times during their terms of office;
(2) Members of either house of the Congress of the United States
during the session of Congress and for fifteen days next before the
beginning and after the ending of any session, and during any time that
they are serving on any committee or performing any other service
under an order or request of either house of Congress;
(3) A judge, grand juror or witness, required by lawful authority
to attend any court or place, during such attendance and while going to
and from such court or place;
(4) Officers and men while going to, attending at, or returning
from, any muster or court-martial ;
(5) Ministers of the gospel while engaged in performing religious
services in a place where a congregation is assembled and while going
to and returning from such place; and
(6) Voters going to, attending at, or returning from, an election.
Such privilege shall only be on the days of such attendance. *
